49. This Lease shall be drafted equally by all parties hereto. The language of all parts of this Lease shall be construed as a whole according to its fair meaning, and any presumption or principle that the language herein is to be construed against any party shall not apply. Headings in this Lease are for the convenience of the parties and are not intended to be used in construing this document. 50. This Lease may be executed in a number of identical counterparts, each of which shall be deemed an original for all purposes. 51. This Lease shall not be assigned or sublet. 52. The rights and remedies provided by the Lease are cumulative, and the use of any one right or remedy by LESSOR, or waiver by either party of any breach of this Lease, or the failure of either parry to enforce any of the provisions of this Lease, at any time, shall not in any way affect, limit or waive such party's right to use any or all remedies thereafter to enforce and compel strict compliance of the Lease. These rights and remedies are given in addition to any other rights LESSOR may have by law, statute, ordinance, or otherwise. 53. Where the terms of this Lease require that notice in writing be provided, such notice shall be deemed delivered three (3) days following the deposit of the notice in the United States mail, postage prepaid, and sent by certified mail, return receipt requested and properly addressed as follows: Lessor: City of Paris P. This Lease shall be binding upon, and inure to the benefit of, the parties of this Lease and their respective heirs, executors, administrators, legal representatives, successors, and assigns when permitted by this Lease. 55. This Lease shall be construed under, and in accordance with the laws of the State of Texas, and all obligations of the parties created by this Lease are performable in Lamar County, Texas.
