<br />3. Applicant will acquire the following interests in <br />the following areas of land, prior to the completion <br />of the project and pledge such land to airport pur- <br />poses to be used as part of or in connection with <br />the project, all of which areas are identified on <br />the attached property map designated Exhibit "A": <br /> <br />nfa <br /> <br />A certificate of attorney verifying the above described <br />interests must be submitted prior to a grant contract <br />offer or immediately subsequent to the acquisition of <br />the land, whichever event occurs first. <br /> <br />SECTION 7 <br /> <br />COVENANTS <br /> <br />If the funds herein, or a portion thereof, are granted, <br />Applicant agrees to the following conditions: <br /> <br />1. The airport or air navigational facility will <br />remain under Applicant's control for at least <br />twenty (20) years. <br /> <br />2. The project must be adequately planned. The <br />Commission will insist that the proposed project <br />conform to the approved Airport Layout Plan and <br />that the specific project be designed in accord- <br />ance with TAC design manuals and specifications. <br /> <br />3. The funds applied for by the applicant may only <br />be used for the establishment, construction, re- <br />construction, enlargement or repair of airports, <br />airstrips or air navigational facilities. <br /> <br />4. At least ten (10) percent of the total project <br />cost will be provided from sources other than <br />the State of Texas. <br /> <br />5. That Applicant has the ability to finance and <br />operate the airport or air navigational facility. <br /> <br />TAC Form 400-5 (11/83) <br /> <br />Page 3 of 4 <br />
