Item No. 16 I TO: Mayor, Mayor Pro Tem and City Council Grayson Path, City Manager FROM: Andrew Mack, AICP SUBJECTS: Final Plat of the Stone Ridge Estates —Addition Phases 10 & 11 DATE: March 28, 2022 BACKGROUND The applicant Mark Cunningham requested approval of a Final Plat for phases 10 & 11 of the Stone Ridge Estates Addition. All approved revisions and conditions of the preliminary plat for phases 10 & 11 were met. This includes final approval of the civil plans for the streets, water, sewer and storm water grading by the City Engineer. The initial intent of the developer was to complete the civil improvements and then seek final plat approval. That plan was later changed and now Mr. Cunningham seeks approval of the final plat. This is to begin pre -selling lots for construction. The final plat must, however, be first approved and recorded to legally sell lots for new home construction The developer requested this change in sequence during the process and is willing to enter into a development agreement. This agreement is to guarantee completion of approved public improvements for construction of streets, water, sewer and drainage improvements. Completion of these public improvements along the entire front linear frontage of the lot will be required prior to issuance of building permits. This is required under the City's Subdivision Ordinance and will be a cited provision under the proposed development agreement. RECOMMENDATION Staff recommends approval of the Final Plat for the Stone Ridge Estates Phases 10 & 11, subject to the following condition: Developer shall enter into a development agreement for completion of all remaining civil improvements and shall be approved by City Council prior to release of the final plat for recording.
