Item No. 16 <br />I <br />TO: Mayor, Mayor Pro Tem and City Council <br />Grayson Path, City Manager <br />FROM: Andrew Mack, AICP <br />SUBJECTS: Final Plat of the Stone Ridge Estates —Addition Phases 10 & 11 <br />DATE: March 28, 2022 <br />BACKGROUND <br />The applicant Mark Cunningham requested approval of a Final Plat for phases 10 & 11 of the <br />Stone Ridge Estates Addition. All approved revisions and conditions of the preliminary plat for <br />phases 10 & 11 were met. This includes final approval of the civil plans for the streets, water, <br />sewer and storm water grading by the City Engineer. The initial intent of the developer was to <br />complete the civil improvements and then seek final plat approval. That plan was later changed <br />and now Mr. Cunningham seeks approval of the final plat. This is to begin pre -selling lots for <br />construction. The final plat must, however, be first approved and recorded to legally sell lots for <br />new home construction The developer requested this change in sequence during the process and <br />is willing to enter into a development agreement. This agreement is to guarantee completion of <br />approved public improvements for construction of streets, water, sewer and drainage <br />improvements. Completion of these public improvements along the entire front linear frontage <br />of the lot will be required prior to issuance of building permits. This is required under the City's <br />Subdivision Ordinance and will be a cited provision under the proposed development agreement. <br />RECOMMENDATION <br />Staff recommends approval of the Final Plat for the Stone Ridge Estates Phases 10 & 11, subject <br />to the following condition: <br />Developer shall enter into a development agreement for completion of all remaining civil <br />improvements and shall be approved by City Council prior to release of the final plat for <br />recording. <br />
