<br />'" <br /> <br />STATE OF TEXAS ~ <br />COUNTY OF LAMAR ~ <br />THAT, the City of Paris, Paris, Texas, a municipal <br />corporation, acting by and through its Mayor, George Fisher, <br />hereinafter referred to as CITY and Wayne Kerby, d/b/a <br />Kerby's Carpet Care, 1954 East Booth, Paris, Texas 75460, <br />hereinafter referred to as KERBY, do contract and agree as <br />follows: <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />1. The CITY wishes to procure aIld KERBY desires to <br />provide maintenance and custodial service for the following <br />City of Paris buildings: City Hall, Water Billing Office, <br />City Hall Annex and the Paris Public Library as described in <br />the bid documents being legal notice, scope of work and bid <br />form, attached hereto as Exhibits "A" through "c" and <br />incorporated herein for all legal purposes and the consider- <br />ation of such services shall be $1,314.00 per month. <br />2. CITY and KERBY each bind respectfully its self, <br />its successors and assigns and heirs to this agreement and <br />to the covenants contained herein. KERBY shall not assign, <br />sublet or transfer its interest in the contract without the <br />written consent of CITY. <br />3. The term of this contract begins on the 1st day of <br />July, 1985, and runs until such time as CITY or KERBY giyes <br />sixty (60) days written notice to the other that the same is <br />terminated, which termination can be without cause. CITY <br />retains the right to terminate said contract upon thirty <br />(30) days written notice for KERBY'S failure to perform the <br />services required under this contract. <br />4.
