Regular Council Meeting <br />June 27, 2022 <br />Page 6 <br />WEEK RESIDENTIAL SOLID WASTE COLLECTION; MAKING OTHER <br />FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A <br />REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, AND A <br />PENALTY CLAUSE; AND DECLARING AN EFFECTIVE DATE. <br />Assistant City Manager Robert Vine said at the May 23, 2022 City Council meeting, the <br />City Council authorized amendments to the Code of Ordinances which transitioned the City <br />Sanitation from twice a week pickup to once a week pickup. He explained those changes <br />authorized up to twelve bags of trash per pickup, per week. <br />Mr. Vine explained that on June 13, 2022, it was brought to the attention of the City <br />Manager that the City inadvertently and unintentionally failed to take into the account the fact <br />that under the old ordinance, each residence had been able to set out an additional six bags of <br />trash on bulk pickup days in lieu of a bulk item. He said this amendment to the Code would <br />make it eighteen bags, which could be trash and/or brush. <br />A Motion to approve this item was made by Council Member Pankaj and seconded by <br />Council Mayor Pro -Tem Hughes and Council Member Pilgrim. Motion carried, 7 ayes — 0 nays. <br />19. Discuss and act on ORDINANCE NO. 2022-041: AN ORDINANCE OF THE CITY OF <br />PARIS, TEXAS, AMENDING CHAPTER 7, ARTICLE 7.03, "SMOKING," TO <br />PROHIBIT THE USE OF ELECTRONIC CIGARETTES IN PUBLIC PLACES AND <br />TO PROVIDE FOR A VARIANCE PROCEDURE FOR SEMI -ENCLOSED AREAS <br />OF PLACES OF EMPLOYMENT; MAKING OTHER FINDINGS RELATED OT THE <br />SAME; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A <br />PENALTY CLAUSE AND PROVIDING AN EFFECTIVE DATE. <br />City Attorney Stephanie Harris said this item was carried over from the last meeting with <br />two additional amendments. She said the first amendment was to include a variance procedure <br />for smoking in semi -enclosed areas and the second amendment was to prohibit electronic <br />cigarettes and vaping in public places. <br />A Motion to approve this item was made by Council Member Knox and seconded by <br />Council Member Savage. Motion carried, 6 ayes — 1 nay, with Council Member Pilgrim casting <br />the dissenting vote. <br />20. Discuss and act on RESOLUTION NO. 2022-046: A RESOLUTION OF THE CITY <br />COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING AND AUTHORIZING <br />AN ECONOMIC DEVELOPMENT AGREEMENT BY AND BETWEEN THE CITY <br />OF PARIS, TEXAS, AND EMERALD HOSPITALITY, LLC; MAKING OTHER <br />FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING <br />AN EFFECTIVE DATE. <br />Mayor Portugal said that Council Member Pankaj had asked to be recused from this item, <br />because he had a conflict.
