Item No. 26 <br />TO: Mayor, Mayor Pro Tem and City Council <br />Grayson Path, City Manager <br />FROM: Andrew Mack, AICP Director Planning & Community Development <br />SUBJECT: Discuss and act on a Resolution amending the 5 in 5 Housing Infill Development <br />Program Guidelines and Criteria to make properties immediately adjacent to the <br />Program Area eligible for the Program. <br />DATE: July 25, 2022 <br />BACKGROUND & DISCUSSION <br />The City is considering the approval of a 5 In 5 Agreement between the City and Mr. Michael <br />Davidson for the construction of 3 new duplexes at the NWC of Fitzhugh and Clement Road. <br />The property is located immediately diagonal to the established 5 In 5 Boundary Area. Hence <br />the specific policy definition question has been raised as to the original intent of the eligibility <br />for properties adjacent to the boundary. This item clarifies the original intention of the 5 In 5 <br />Guidelines to apply to both sides of the road where the boundary exists along a street. This was <br />promoted prior to and following inception of the policy by staff in discussion with numerous <br />builders. There are areas along the established boundary where both sides of the street share a <br />similar neighborhood characteristic and may involve demolition of older structures in the future. <br />In such instances, the policy should apply to both properties along the boundary line. The <br />approval of this resolution provides for a very minor clarification in the definition section <br />allowing the original intent under the 5 In 5 Policy to permit agreements where the property is <br />located immediately adjacent to or diagonal to the boundary when such property eligibility <br />instances exist. This clarification is not, however, an intention to adjust the original boundary <br />of the 5 In 5 Eligibility Area. <br />Recommendation <br />Approval of the Resolution amending the 5 in 5 Housing Infill Development Program <br />Guidelines and Criteria to make properties immediately adjacent to the Program Area eligible <br />for the Program is recommended. <br />
