RESOLUTION NO.84 -005 <br />WHEREAS, Ordinance No. 2424 adopted on final passage <br />December 11, 1978, granted to Midwest Video Corporation a <br />franchise to use specified public facilities for business <br />related purposes; and, <br />WHEREAS, provisions of Ordinance 2424 provided, in <br />part, as follows: Section 3 "that the service furnished <br />and provided hereunder to said City and its inhabitants <br />shall be first class in all respects... ". Section 4 "the <br />City of Paris shall have the right to fix the rates to be <br />charged by the grantee herein by ordinance ... "; and, <br />WHEREAS, Ordinance 2538 passed November 10, 1980, <br />granted Midwest Video Corporation authority to charge <br />certain specified rates; and, <br />WHEREAS, one of the reasons given for the need of the <br />rate structure authorized in Ordinance 2538 was to estab- <br />lish adequate fiscal resources to allow system improvement <br />and maintenance of "first class" service; and, <br />WHEREAS, complaints received by members of the City <br />Council of the City of Paris, as well as their own observa- <br />tion caused such members to question whether or not the <br />service being provided by Midwest Video Corporation is <br />"first class in all respects "; and, <br />WHEREAS, the matter was discussed with representatives <br />of Midwest Video Corporation in a regularly scheduled City <br />Council meeting on September 12, 1983, at which time such <br />representatives agreed service provided by Midwest Video <br />corporation was not "first class in all respects "; and, <br />WHEREAS, such representatives agreed to improve service <br />to a "first class" level and to report back to the City <br />Council on December 12, 1983; and, <br />WHEREAS, at a regular Council meeting on January 9, <br />1984, representatives of Midwest Video Corporation reported <br />to the City Council that although system improvements had <br />been made, service provided by Midwest Video Corporation <br />still was not "first class in all respects "; and, <br />WHEREAS, the City Council believes that the rates <br />authorized by Ordinance 2538 were reasonable for service <br />provided by Midwest Video Corporation if it is "first class <br />in all respects "; NOW, THEREFORE, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />PARIS, that the City Council of the City of Paris, Paris, <br />Texas does hereby find that there is sufficient reason to <br />question whether or not the quality of service provided by <br />Midwest Video Corporation is a failure to comply with the <br />terms of its franchise or is "first class in all respects" <br />and therefore justifying the rates authorized by Ordinance <br />2538 and does hereby call a public hearing for 5:15 o'clock <br />P.M. on the 21st day of February, 1984 to be held in the <br />Council room, City Hall, Paris, Texas to hear evidence <br />concerning such service. <br />BE IT FURTHER RESOLVED, that by copy of this Resolution <br />being delivered to the Office of Midwest Video Corporation <br />in Paris, Texas, such Midwest Video Corporation is notified <br />to show cause, if any it has why its franchise should not be <br />repealed or why its rates should not be decreased. <br />
