Staff recommends approval of the change in zoning from an Agricultural District (A) to a <br />Planned Development District (PD), subject to the following conditions: <br />1. All additional required permits and plat approvals shall be obtained. <br />2. The business owner shall comply with all required Federal, State and Local <br />laws. <br />3. There shall be no clear -cutting of any mature trees and vegetation upon the <br />PD rezoned property or the non -rezoned AG property for future single- <br />family residential under the same ownership by the applicant unless a tree <br />removal and landscape buffering plan is first approved by the Director of <br />Planning & Community Development. <br />The public hearing was declared open. Citizens spoke in opposition of the petition citing <br />concerns about the potential clear -cutting of the heavily forested areas south of the existing <br />residential subdivision and the high voltage transmission lines. Citizens also expressed <br />concerns of noise and low-income Section 8 housing. Developer Alan Naul of Dallas <br />states this is a tax credit proposal and not for Section 8 housing or a subsidiary project. <br />Naul states they have no plans to develop the back portion of the property at this time. This <br />will be a high quality, single -story, single apartment project. Naul states their development <br />is for seniors only, deed restricted with 76 dwelling units proposed. <br />A motion was made by Sims Norment, seconded by Michael Mosher to approve the change <br />in zoning from an Agricultural District (A) to a Planned Development District (PD). <br />Motion carried 4-0. <br />12. Consideration of and action on the Preliminary Plat of the PUD 61 Addition, Lot 1, Block <br />A, LCAD 14462, located at 455 NE 6th Street. <br />A motion was made by Austin Anthony, seconded by Michael Mosher to approve the <br />preliminary plat with noted conditions. Motion carried 4-0. <br />13. Consideration of and action on the Preliminary Plat of the Lone Star Addition, Lot 1, Block <br />A, LCAD 18634, 18635, 102228, located at 1421 NE 19th Street. <br />A motion was made by Austin Anthony, seconded by Michael Mosher to approve the <br />preliminary plat with noted conditions. Motion carried 4-0. <br />14. Consideration of and action on the Final Plat of the Lone Star Addition, Lot 1, Block A, <br />LCAD 18634, 18635, 102228, located at 1421 NE 19th Street. <br />A motion was made by Michael Mosher, seconded by Austin Anthony to approve the <br />final plat with noted conditions. Motion carried 4-0. <br />
