LESSEE covenants and agrees that he will not <br />hold CITY or any of its agents responsible for any <br />loss occasioned by fire, theft, rain, windstorm, <br />hail, or any other cause whatsoever, whether said <br />cause be the direct, indirect, or merely a con- <br />tributing factor in producing the loss to any <br />airplane, automobile, personal property, parts or <br />surplus that may be located or stored in the <br />hangers, offices, aprons, field, or any other <br />location at the airport; and LESSEE agrees that <br />the aircraft and its contents are to be stored at <br />airport; and LESSEE agrees that the aircraft and <br />its contents are to be stored at LESSEE I S risk <br />whether on the field or in the hangers, not <br />withstanding the aforesaid LESSEE does not forfeit <br />the rights that other members of the flying public <br />have. <br /> <br />7. LESSEE agrees to indemnify, defend, hold <br />harmless the CITY, its agents, officers, and <br />employees, from and against any and all liability <br />or loss resulting from claims or court action <br />arising directly or indirectly out of the acts of <br />LESSEE, his agents, servants, guests, or business <br />visitors under this agreement or by reason of any <br />act or omission of such person arising from any <br />use of the airport premises and/or facilities. <br /> <br />8. LESSEE agrees that in the event of any <br />misrepresentation or default by LESSEE regarding <br />any of the obligations of this agreement CITY may <br />impound all aircraft and padlock all facilities of <br />LESSEE herein leased. LESSEE further covenants and <br />agrees that LESSEE will, upon failure to pay the <br />rental hereinabove agreed upon, yield up unto CITY <br />all and singular the leased premises in good <br />condition, reasonable use and wear and tear <br />accepted; LESSEE further covenants and agrees that <br />if LESSEE shall fail to pay the rental hereinabove <br />agreed upon, CITY may lawfully at any time there- <br />after, after five (5) days written notice by <br />depo~iting in the U.S. Mail addressed to the last <br />known address of LESSEE, enter upon the leased <br />premises or any part thereof and remove LESSEE 's <br />aircraft thereform, forcibly if necessary, without <br />being taken or deemed guilty of any manner of <br />trespass, and without liability on the part of the <br />CITY of any kind or nature whatsoever, and <br />without prejudice to any legal remedies which <br />might otherwise be used by CITY for possession of <br />said premises or for arrears of rent, and that <br />
