ORDINANCE NO. 2022-060 <br />AN ORDINANCE OF THE CITY OF PARIS, TEXAS, ALLOWING EMPLOYEES OF <br />THE FIRE DEPARTMENT AS DESCRIBED HEREIN TO PARTICIPATE IN THE <br />TEXAS MUNICIPAL RETIREMENT SYSTEM ("TMRS"); PROVIDING FOR <br />REPEAL OF ORDINANCES IN CONFLICT; AND PROVIDING AN EFFECTIVE <br />DATE. <br />WHEREAS, the City of Paris, Texas (the "City") is a municipality that participates in the <br />Texas Municipal Retirement System ("TMRS" or the "System") pursuant to the provisions of the <br />Texas Government Code, Title 8, Subtitle G, as amended (the "TMRS Act"); and <br />WHEREAS, §852.001 of the TMRS Act provides that a municipality may elect to have <br />one or more of its departments participate in the System; and <br />WHEREAS, pursuant to City Ordinance No. 1218 dated May 22, 1950, the City elected <br />to have all employees and future employees of the City departments named in such Ordinance <br />participate in TMRS, and such Ordinance specifically excepted the City's Fire Department from <br />participation in TMRS; and <br />WHEREAS, pursuant to City Ordinance No. 2062 dated December 13, 1971, and <br />effective as of January 1, 1972, the City elected to have all employees of all City departments <br />then existing or thereafter established participate in TMRS, but again specifically excepted the <br />City's Fire Department from participation in TMRS; and <br />WHEREAS, pursuant to City Ordinance No. 2352 dated September 12, 1977, the City <br />elected to have employees of the City's newly created Library Department participate in TMRS; <br />and <br />WHEREAS, pursuant to City Ordinance No. 83-060 dated September 26, 1983, and <br />effective as of October 1, 1983, the City elected to have "the employees of the Paris -Lamar <br />County Health Unit which acts as the Health Department for the City of Paris who are not <br />employees of the State of Texas and all departments now existing and those hereafter created, <br />except those employee[s] of the Fire Department who are included in or who are eligible to be <br />included in membership in Firemen's Relief and Retirement Fund of the City of Paris, <br />participate in the Texas Municipal Retirement System as provided in the TMRS Act"; and <br />WHEREAS, the City of Paris has a regularly organized Fire Department for which the <br />Firemen's Relief and Retirement Fund of the City of Paris referred to above (hereafter the "Fire <br />Fund") was established under Section 4 of the Texas Local Fire Fighters Retirement Act, Article <br />6243e, Vernon's Texas Civil Statutes (the "TLFFRA Act"); and <br />WHEREAS, the City Council of the City of Paris finds that it will be in the best interest of <br />the City to have existing employees of the Fire Department who are not participating in TMRS <br />pursuant to City Ordinance No. 83-060 and all future employees of the Fire Department <br />
