I <br />DECISION OF THE BOARD OF ADJUSTMENT, CITY OF PARIS, TEXAS <br />RE: 423 N Main Street- Variance Request <br />Marx Offutt <br />4808 CR 22880 <br />Paris, TX 75460 <br />ACTION REQUESTED: Variance to allow existing asphalt parking lot to remain. <br />The above -reference request was granted in part with conditions by the City of Paris Zoning Board <br />of Adjustment ("Board") on 9/6/2022 by a vote of ayes, ._ . 0 . _ nays and ................ <br />abstaining. <br />.m rabstaining. On this date, the Board found that the request met the conditions set forth in the Off - <br />Street Parking and Loading Regulations, Section 10-110(a) of the City of Paris Zoning Ordinance. <br />Appeal: Any interested person wishing to appeal this Board decision is required to file a petition <br />for Writ of Certiorari in a district court, county court or county court at law within ten (10) days <br />of the date this decision is filed in the Board's office consistent with section 211.011 of the Texas <br />Local Government Code. <br />The Board of Adjustment here by grants in part, the variance request based upon the following <br />conditions and findings of fact. <br />CONDITIONS: <br />1. Existing asphalt parking lot must be swept. <br />2. Existing asphalt parking lot must be seal coated. <br />3. The above conditions be completed prior to issuance of the Certificate of Occupancy. <br />BOARD RECOMMENDED FINDINGS <br />1. The request for variance is in harmony with the general purpose and intent of the Zoning <br />Ordinance and does maintain the spirit and intent of the Off -Street Parking Requirements <br />which serve to promote a higher quality of appearance and safety for all commercial re- <br />development projects within the community. <br />2. The conditional grant of the requested variance permits utilization of the existing paved <br />surface, with conditions thus allowing the reasonable use of the property for the proposed new <br />
