the effect of removing the dedication requirement for Lot 10. In order to achieve this request, City <br />Staff initiated a 2nd agenda item on property owned by Terry and Sandra Fitzgerald. This would <br />be necessary to maintain the route continuity for the future arterial street contained in the plan. <br />Their attorney contacted me to express not only their strong objection to the change, but also the <br />plan affecting their property in its entirety. <br />The Development Staff Team believes this classification, as shown on the `Delete All' plan <br />between FM 195 and Lamar Avenue (TH 82), is unrealistic as drawn (see attached exhibit). Staff <br />believes the origin of this segment of the plan pre -dates the majority of development in this portion <br />of the city over the past 30+ years. Although Mr. Whitaker was required to apply for the <br />amendment, Staff strongly recommends that this entire segment be temporarily removed in its <br />entirety (the `Delete All' option). This would afford plenty of additional time for the City to study <br />this portion of the future extension of the arterial out into the future growth area of the Northwest <br />portion of the City to accommodate new development over time. <br />An update could then be brought forward once a more suitable plan can be prepared with <br />reasonable accommodation and respect to both developed and undeveloped properties. It was <br />recommended that the Planning & Zoning Commission consider the 3 below Staff <br />recommendation options for this project: <br />1. Deny the requested changes. <br />2. Accept withdraw of the applications. <br />3. Table action on the applications. <br />City Staff recommended option 3 and the P&Z tabled action until the November 7 P&Z meeting. <br />It is recommended that the City Council not open the hearing on these agenda items, but rather <br />approve a motion passing over these agenda items and tabling action until its Novemberl4, 2022 <br />meeting. <br />Page 2 of 2 <br />
