SERVICE ANNEX <br />CLARO ENTERPRISE SOLUTIONS, LLC. UNIFIED COMMUNICATIONS AS A SERVICE (UCaaS) <br />to civil liability, or otherwise violate any applicable local, state, national, or <br />international law. CUSTOMER agrees that CES has no liability sustained <br />from CUSTOMER misuse of Call Recording service. CES reserves the <br />right to immediately and without notice, suspend or terminate the service <br />and discard any content stored within the service, in the event that the <br />content is determined to have violated any such laws or regulations, or <br />any terms or conditions of this Service Annex. <br />16.0. Privacy <br />CES is committed to respecting CUSTOMER privacy. CUSTOMER 's <br />personally identifiable information will only be used in the context of the <br />CUSTOMER relationship with CES. We will not sell, rent, or lease <br />CUSTOMER personally identifiable information to others. Unless <br />required by law or subpoena or if CUSTOMER's prior permission is <br />obtained, CES will only share the personal data CUSTOMER provides <br />with other CES entities and/or business partners that are acting on CES' <br />behalf to complete the activities described herein. <br />17.0. Ex ort Com fiance <br />CUSTOMER agrees to comply with the United States export laws <br />concerning the transmission of technical data and other regulated <br />materials via the Services. CUSTOMER agrees to comply with applicable <br />local, state and federal regulations governing the locality in which the <br />Equipment and Services are used. <br />18.0. Phone Numbers and Web Portal Discontinuance <br />Upon expiration, cancellation or termination of the Services, CUSTOMER <br />shall relinquish and discontinue use of any phone numbers, voice mail <br />access numbers and/or web portals assigned to CUSTOMER by CES or <br />its vendors. CUSTOMER phone numbers can be ported to another <br />service provider as long as the CUSTOMER's account is current and in <br />good standing. <br />19.0. Software Copyright <br />Any software used or provided by CES to CUSTOMER in conjunction with <br />providing the Services are protected by copyright law and international <br />treaty provisions. CUSTOMER may not copy the software or any portion <br />Of it. <br />20.0. Civil Works <br />Unless expressly specified, the cost of civil works, wiring, cabling or any <br />other type of work necessary to configure CUSTOMER sites are not <br />factored into the price of the Service. If, as a result of a site survey, it is <br />concluded that civil works, wiring, cabling or any other type of work is <br />needed to install a managed device at CUSTOMER premises, <br />CUSTOMER shall be given a list of the specifications and requirements <br />needed in order to have such site(s) ready for the service. CUSTOMER <br />shall be fully responsible for all expenses related to these changes. <br />CUSTOMER may choose (or may be required) to contract the work to be <br />done by a separate company. In either event, CUSTOMER is fully <br />responsible for the cost of any work that is needed and agrees that all <br />configurations shall be done in accordance with the specifications and <br />standards as set forth by CES, its Affiliates or subcontractors. All the site <br />configurations carried out by CUSTOMER or CUSTOMER's contractor <br />shall not take more than thirty (30) calendar days after the CUSTOMER's <br />service administrator is notified in writing by CES of such works. If CES is <br />not notified in writing of the termination of the site's changes within fifteen <br />(15) calendar days after the 30 -day period, CES. shall commence billing <br />for all the Services contracted within such site(s). <br />V.10.22 CLARO ENTERPRISE SOLUTIONS, LLC - PROPRIETARY <br />Page 6 of 6 <br />
