DATE: December 12, 2022 <br />BACKGROUND <br />The applicant requests approval of a Replat. The property is zoned PD and is the site of the <br />former Sears Store. The intended purpose for the platting is to separate a larger parcel into 3 <br />to facilitate the sale of part of the shopping center for the conversion into a storage facility. <br />The replat was recommended for approved by the P&Z on 12/5/22. <br />RECOMMENDATION <br />Staff recommends approval of the replat, subject to the following recommended engineering <br />conditions: <br />1. There are obstructions within the called 24' wide emergency access easement on the east <br />side of the building. These obstructions include painted parallel parking spaces, an <br />awning and a concrete loading ramp. For this to be an acceptable emergency access <br />easement, these obstructions should be removed. Chapter 9, Exhibit A, Section V (8). <br />2. The called 35' wide emergency access easement running east/west on the north side of <br />the existing building should be 30' wide. This is based on the existing parking striping <br />and a measured width of only 30' between the parking spaces. Chapter 9, Exhibit A, <br />Section V (8). <br />3. If the lot is owned by another entity (e.g. Lot 2), then a cross access easement cannot be <br />added by this plat on Lot 2 unless that owner also agrees and signs this plat. Chapter 9, <br />Exhibit A, Section V (8). <br />4. It appears that Tokyo Express (Lot 7) has an old billboard, a row of parking and a <br />dumpster enclosure on Lot 3-C. Please confirm and show this on the replat with labels. <br />Chapter 9, Exhibit A, Section IV (6). <br />a. If these items are in fact on Lot 3-C, then some sort of access easement should be <br />granted to Lot 7 through this plat. Chapter 9, Exhibit A, Section V (8). <br />
