Item No. 18 <br />Memorandum <br />TO: Mayor, Mayor Pro -Tem and City Council <br />Grayson Path, City Manager <br />FROM: Andrew Mack, AICP Director Planning & Community Development <br />SUBJECT: Conduct a public hearing and take action regarding the petition of Mitch Milam, <br />Texas Land Direct, LLC for a change in zoning from a One -Family Dwelling <br />District No. 3 (SF -3) to a Two -Family Dwelling District (2F) in the City of <br />Paris, Block 281, Lot 6, LCAD 18409, located at 1610 NE 15th Street. <br />MTG. DATE: December 12, 2022 <br />BACKGROUND <br />The applicant requested a rezoning change from SF -3 to 217, which would permit the future construction <br />of new duplexes. In initial discussion with the applicant, there was interest expressed for entering the <br />5 In 5 Infill Housing Program and to potentially include the land to the South which is eligible for tax <br />foreclosure. After further discussion with the applicant, Mr. Milam concluded that his rezoning request <br />to 2F was incorrect to meet the future marketing plans for the sale and development of the property. <br />He has no plans at this time to develop the property. As a result, he has submitted the attached request <br />for tabling action on this application in order to re -submit the request for MF -1. This will need to be re - <br />advertised with new notices mailed out to the neighborhood. <br />The P&Z opened the Public Hearing and received comments from Shirley Thomas the landowner of <br />an undeveloped lot to the West. She did not express objection to the change, but was in attendance to <br />hear the discussion on the request. The P&Z then approved a motion to continue the hearing to their <br />January 3, 2023 meeting. The Council will not need to do this since the application rezoning to 2F has <br />become a moot point given the applicant has now requested to revise the request to MF -1 thereby <br />withdrawing the request for 2F. City Council will conduct the public hearing on this new application <br />at its January 23, 2023 meeting. <br />RECOMMENDATION <br />Staff recommends that the City Council pass over this item. <br />
