maps, and that the legal description as approved in the Ordinance 2019-045 did not support either <br />one of these maps. The TIRZ Board itself has since then termed out and is currently vacant. These <br />issues were realized this last Fall of 2022 and City Staff went to work to correct this. Thisagenda <br />item is strictly clean u, we have not proposed any edits of substance to the documents as they <br />were approved and/or intended to be approved in late 2019 and early 2020, other than to complete <br />the revisions of the bylaws as directed by the City Council on February 24, 2020, to clean up the <br />boundary description in the ordinance, and to create a new board. <br />STATUS OF ISSUE: <br />Upon discovering the issues stated in the Background section above, City Staff have performed <br />the following tasks: <br />1. Engineering Department reviewed and revised the legal description that was approved in <br />Ordinance 2019-045, not to change the boundaries, but to more correctly describe the <br />boundaries that then allowed us to produce an accurate TIRZ map (attached), ruling out <br />both of the older conflicting maps. The City Attorney Department has prepared an <br />amendment to Ordinance 2019-045 to revise the legal description of the TIRZ zone, for <br />your review and approval tonight. <br />2. Attorney Department has revised the Board Bylaws as was directed by the City Council on <br />February 24, 2020 and has prepared those for your review and approval tonight. <br />3. Finance Department has worked with LCAD to determine the amount of funds that would <br />have been contributed to the TIRZ fund account had it been filed back in 2020. The LCAD <br />provided us the valuation increases and City Staff performed the calculations as determined <br />in Sections 12 and 13 of the Project and Financial Plan (see the Budget section below). An <br />amount of $97,420.92 was determined as the current value. The City Manager directed that <br />this amount be transferred to the TIRZ fund to make it whole as if it had been funded since <br />the passing of this ordinance. <br />4. Community Development Department has reviewed the board appointment language <br />requirements. The bylaws call for five board members, all being residents of Lamar <br />County, and two being City employees. The City Council is tasked with determining the <br />three non -city employees while City Staff would like to recommend 1) Rob Vine, Assistant <br />City Manager, and 2) Thomas McMonigle, Fire Chief, as the two city employee seats. As <br />far as the three remaining positions, we recommend that the City Clerk advertise for these <br />positions along with all other board positions for the Council to review and consider this <br />summer. <br />
