Item No. 14 <br />Memorandum <br />TO: Mayor, Mayor Pro Tem and City Council <br />Grayson Path, City Manager <br />FROM: Todd Mittge, City Engineer <br />SUBJECT: Consideration of and action on the amendment of approval conditions of the Park <br />Place Shopping Center —Unit One Addition Replat (Approved with Conditions <br />December 12, 2022) <br />DATE: April 18, 2023 <br />BACKGROUND <br />City staff requests an amendment to approval conditions 1 and 4 that were approved by the 12-12- <br />2022 City Council. City staff has reached an agreement with the developer to resolve these issues <br />on the site plan. <br />RECOMMENDATION <br />Staff recommends amendment of the following approval conditions: <br />- <br />-- -.60NO <br />W <br />a. The City Staff is requesting that this approval condition be amended to say that a <br />solution concerning the loading ramp shall be resolved via the site plan in a way that is <br />satisfactory to the Fire Marshall. <br />2. The called 35' wide emergency access easement running east/west on the north side of the <br />existing building should be 30' wide. This is based on the existing parking striping and a measured <br />width of only 30' between the parking spaces. Chapter 9, Exhibit A, Section V (8). <br />3. If the lot is owned by another entity (e.g. Lot 2), then a cross access easement cannot be added <br />by this plat on Lot 2 unless that owner also agrees and signs this plat. Chapter 9, Exhibit A, Section <br />V (8). <br />
