ORDINANCE NO. 2023-029 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, <br />AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, <br />TEXAS, ESTABLISHING A HISTORIC OVERLAY DISTRICT COMPRISING <br />THE PINE BLUFF AND FITZHUGH NEIGHBORHOOD TO BE NAMED <br />HISTORIC OVERLAY DISTRICT NO. 19 (HD -19) AND ENCOMPASSING <br />21 ACRES INCLUDING THE 500-900 BLOCKS OF PINE BLUFF STREET, <br />THE 300-600 BLOCKS OF FITZHUGH AVENUE, THE SOUTH SIDE OF <br />THE 600-700 BLOCKS OF EAST CHERRY STREET, THE EAST SIDE OF <br />THE 300 BLOCK OF 6TH NE, THE 300 BLOCK OF 8TH STREET NE, AND <br />THE ADDRESSES 803, 925, AND 936 EAST BOOTH STREET; MAKING <br />OTHER FINDINGS AND PROVISIONS RELEATED TO THE SUBJECT; <br />PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A <br />SAVINGS CLAUSE, A PENALTY CLAUSE; AND DECLARING AN <br />EFFECTIVE DATE. <br />WHEREAS, the City Council of the City of Paris, Texas, has received a request <br />from the Paris Historic Preservation Commission for an amendment to the zoning <br />ordinance of the City of Paris to establish a Historic Overlay District (HD) comprising <br />the Pine Bluff and Fitzhugh neighborhood and encompassing 21 acres to include the <br />500-900 Blocks of Pine Bluff Street, the 300-600 Blocks of Fitzhugh Avenue, the South <br />side of the 600-700 Blocks of East Cherry Street, the east side of the 300 Block of 6th <br />NE, the 300 Block of 8th Street NE, and the addresses 803, 925, and 936 East Booth <br />Street in the City of Paris, Texas; and <br />WHEREAS, this Historic Overlay District will have the same boundaries as the <br />national designation of the neighborhood by the National Register of Historic Places; <br />and <br />WHEREAS, the creation of the Historic Overlay District, to be designated as <br />Historic Overlay District No. 19 (HD -19), will make the properties in the district <br />eligible for the same city fagade grants and architectural reviews by the Historic <br />Preservation Commission to preserve the historic character of the neighborhood as <br />are available in other Historic Overlay Districts in the city; and <br />WHEREAS, on May 11, 2022, the Historic Preservation Commission reviewed <br />the request, and, after notice to the property owners within the proposed district and <br />a public hearing thereon, recommended that the Historic Overlay District on this <br />property be approved in accordance with the city zoning ordinance and state law; <br />and <br />WHEREAS, on June 6, 2023, the Planning and Zoning Commission conducted <br />a public hearing on said proposed amendment after notice and publication as <br />required by law, and, following said hearing, made formal recommendation to the <br />City Council in favor of said proposed Historic Overlay District No. 19; and <br />
