ORDINANCE NO. <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, <br />AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, TEXAS, <br />AS HERETOFORE AMENDED, SO AS TO ALLOW A SPECIFIC USE PERMIT <br />(SUP) FOR AUTO FUEL SALES IN A COMMERCIAL DISTRICT (C) IN THE <br />CITY OF PARIS BLOCK 251, LOT PT OF 27-13, LCAD #53673, LOCATED AT <br />2335 N. MAIN STREET; PROVIDING A REPEALER CLAUSE, A <br />SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND <br />PROVIDING AN EFFECTIVE DATE. <br />WHEREAS, the Planning and Zoning Commission received a request for an <br />amendment to the Zoning Ordinance of the City of Paris for a specific use permit (SUP) for <br />auto fuel sales in a Commercial District (C) in the City of Paris Block 251, Lot PT of 27-B, <br />LCAD #53673 located at 2335 N. Main Street; and, <br />WHEREAS, on October 2, 2 02 3, following notice and publication as required by law, <br />the Planning and Zoning Commission conducted a public hearing on the proposed <br />amendment to the City Zoning Ordinance for an SUP for auto fuel sales in a Commercial <br />District (C), and, following said hearing, made formal recommendation to the City Council to <br />approve the requested specific use permit subject to the following conditions: <br />1. Approval of the site civil construction improvements by the City Engineer, <br />Fire Marshal, and Planning and Community Development Director prior to <br />issuance of the site civil and building/canopy remodel permits. <br />2. All broken or damaged pavement sections shall be fully repaired or <br />replaced. <br />3. Full compliance with the off-street parking striping and handicapped <br />parking requirements of the Zoning Ordinance. <br />4. Where feasible, additional greenspace and planting of canopy trees and <br />shrubbery shall be added to the site and the greenspace area increased by <br />4% to comply with the buffering standards contained in Section 30-100 of <br />the Zoning Ordinance. <br />S. The dumpster storage area shall be upgraded in conformance with the trash <br />enclosure storage requirements of the Zoning Ordinance Section 30-203. <br />6. Full compliance with TCEQ fuel replacement requirements with <br />documentation affirming compliance shall be provided to the City's Fire <br />Marshal prior to issuance of site civil and building permits. <br />7. Full conformity with all other requirements of the Zoning Ordinance, <br />including Section 12-100 of the Zoning Ordinance, all applicable <br />requirements of the Subdivision Ordinance, and all applicable City <br />Development Guidelines and Standards. <br />
