✓ wucn✓*wr��r an ,�� <br />r' <br />u <br />DECISION OF THE BOARD OF ADJUSTMENT, CITY OF PARIS, TEXAS <br />RE: 2801 E Price St- Variance Requests <br />James Martinez <br />820 SE 47t` St <br />Paris, TX 75460 <br />ACTION REQUESTED: <br />1) 10' variance to the front yard setback on E Price Street, Section 9-501(1). <br />2) 40' variance to lot depth, Section 9-301(1). <br />The above -referenced requests were approved by the City of Paris Zoning Band of Adjustment <br />("Board") on 10/3/2023 by a vote of Cayes, nays and _ m_,,,,,,,_ abstaining. <br />On this date, the Board found that the requests met the conditions set forth in the City of Paris <br />Ordinance, sections mentioned above. <br />Appeal: Any interested person wishing to appeal this Board decision is required to file a petition <br />for Writ of Certiorari in a district court, county court or county court at law within ten (10) days <br />of the date this decision is filed in the Board's office consistent with section 211.011 of the Texas <br />Local Government Code. <br />The Board of Adjustment hereby approves the variances request based upon the following <br />condition(s) and findings of fact. <br />Condition Ds <br />1. Beginning at the 25' build line on NE 28ffi Street, 128' of privacy fence must be installed along <br />the northern property line running east and west, with a maximum height of 7'. <br />2. Mature trees in right of way along E Price and NE 28h Street must be preserved. <br />3. Off-street parking must be located entirely on the property. <br />Findings <br />1. The request for variance is in harmony with the general purposes and intent of site <br />improvement regulations contained in the Zoning Ordinance 1710 Exhibit 9B and the <br />Subdivision Ordinance 1315 Exhibit 9A; and will protect the character of the immediate <br />vicinity of the area. <br />
