B. "This agreement shall be automatically amended to reflect any salary adjustments that <br />are provided or required by the Employer's compensation policies to include all salary <br />adjustments on the same basis as applied to the department head classification of <br />employees." <br />C. "In addition, consideration shall be given on an annual basis to a merit increase in <br />compensation. Employee acknowledges that Employer is a governmental entity subject <br />to budgetary constraints and a fluctuating tax base. Consequently, the Employer makes <br />no representation that such a salary merit increase will be granted." <br />D. "At anytime during the term of the Agreement, Employer may, in its discretion, review <br />and adjust the salary of the Employee, but in no event shall the Employee be paid less <br />than the salary set forth in Section 3.A. of the agreement except by mutual written <br />agreement between Employee and Employer. Such adjustments, if any, shall be made <br />pursuant to a lawful governing body action. Each salary adjustment, other than a cost -of - <br />living adjustment, shall be documented by attaching a copy of the minute order of the <br />City Council granting such adjustment to this Employment Agreement." <br />Section 12: Performance Evaluation, Subsection A, shall be amended to read as follows: <br />"Employer may annually, between the months of January and May, review the <br />performance of the Employee using a process, form, criteria, and format for the <br />evaluation, which shall be mutually agreed upon by the Employer and Employee. The <br />Employer shall provide the Employee with a summary statement of the findings of the <br />Employer and shall provide an adequate opportunity for the Employee to discuss his <br />evaluation with the Employer. Employer may conduct a performance review of Employee <br />at any other time it deems advisable should performance issues arise outside of the <br />annual, discretionary review." <br />The effective date of this Addendum Number 3 is January 29, 2024. <br />Employer <br />By: �. <br />Reginald B.
