<br />WHFRE.A.S, the City of Paris, Texas Is a Home Rule Municipality ("City"); and
<br />WHEREAS, Mapter 252.021, Texas Local Government Code, states that
<br />"'before 2. municipality may erut Intoa contract, that requires an expenditure of niore
<br />than $50,000.910 from one or more municipal funds, the municipality rnusL'
<br />fficoinply with a inethmi described hy Chapter 2269, Texas Goviemurnent Code"; and
<br />WHEREAS, Cll,iaP ter 22619, Texas Goverriment (,'ode, governs the procedures f6r
<br />the contracting and delivery of construction projeas for municipalides; and
<br />WHEREAS, Chapter 2269 provides several methods 1,,:)y which a city :may
<br />procure and contraict for such services; and
<br />WHEREAS, Chapter 2269, Subchapter C, sets foilh the competitive bidding
<br />method whereby a g7overnmemental entity may contract f the construction, alteration,
<br />rebial'ARWdon, or repair of a "facility", defined. as an Improvement to real property, by
<br />awarding the contraCt W d -le Joweq, responsible bidder; and
<br />WHEREAS, Section 2269.055 sets forth criteria that a goveimn-siental entity may,
<br />consider in awarding a contract under Chapter 2269, including but not 11miteld to the
<br />safety recurd of the offerior; the o5bror's ex3,,.)erfen.re and reputatilion; and any other
<br />releviant fieri. in requests forbids, proposals, orqualifications; and
<br />WHEREAS, the City Council of tlie City of Paris, Texas, desirves to implement
<br />Texas (kwerrirnient Code Chapter 2269 and to adopt a Safety Record Policy and Bid
<br />Specification Cdterli to review the performance of all prospecAlve bidders in
<br />cletc; mining the most respansible bid, under "h l.: ter 2269, Subchapter C as well as tn
<br />awarding contracts, purrsuant to the other rnettiods outhned and allowable under said
<br />Chapter, and
<br />WHEREAS, the City of'Pariswill include in the specifications ion various bid
<br />'projects a safety application and safety surve,y related to the safety record of
<br />prospective bidders and will set, ouit the criteria by which the bids, proposals, or
<br />qualifications will be judged; and
