RE*- 950 E Austin St- Variance Request <br />Lyle Edwards <br />RT Fitness <br />950 E Austin St <br />Paris, TX 75460 <br />ACTION REQUESTED: 5'2" variance to minimum 10' rear yard setback. <br />The above -referenced request was approved by the City of Paris Zoning Board of Adjustment <br />("Board") on 11/5/2024 by a vote of ayes, 0 nays and 00 abstaining. <br />On this date, the Board found that the request met the conditions set forth in the City of Faris Area <br />Regulations Ordinance, Section 9-701(2). <br />Appeal: Any interested person wishing to appeal this Board decision is required to file a petition <br />for Writ of Certiorari in a district court, county court or county court at law within ten (10) days <br />of the date this decision is filed in the Board's office consistent with section 211.011 of the Texas <br />Local Government Code. <br />The Board of Adjustment hereby approves the variance request based upon the following findings. <br />STAFF RECOMMENDATION & FINDINGS <br />1. The lot is platted. <br />2. The request for variance is in hannony with the general purposes and intent of the proposed <br />district and will not harm the health, safety and welfare that will protect the character of <br />the immediate vicinity of the area. <br />3. The applicant has indicated a hardship sought because the building was constructed 37 <br />years ago by St. Joseph hospital and was placed on the site to avoid an existing City of <br />Paris 10" water line running diagonally across the property that required the building to be <br />setback to its present location. Thus,, creating a hardship for future expansion resulting in <br />a special and unique condition of restricted area of the lot, that exist on the subject parcel <br />of land, which are not applicable to other parcels of land in the current Office (0) Zoning <br />District, and which cause unusual and practical difficulty or unnecessary hardship to the <br />use of the property with site improvements and expansions permitted by the ordinance with <br />
