Harris, City Attorney <br />SUBJECT: Assignment of Tax Abatement—Habitat for Humanity <br />DATE: January 27, 2025 <br />BACKGROUND: The City entered into a residential tax abatement agreement (Agreement) with <br />Habitat for Humanity (Habitat) in May of 2022 for the construction of a single family home located <br />at 743 E. Polk St. Habitat completed construction in December of 2023 and transferred title to <br />April Cash in January of 2024. To date, the Agreement has not been assigned to Ms. Cash, and the <br />issue has arisen in conjunction with Ms. Cash's claiming the abatement for her 2024 ad valorem <br />taxes. The Agreement anticipates assignment to the ultimate homeowner subject to Council <br />approval. <br />STATUS OF ISSUE: Attached hereto is an unexecuted assignment instrument which transfers <br />the agreement from Habitat to Ms. Cash. I anticipate that we will have in hand an executed <br />assignment by the time of the meeting on Monday, January 271H <br />BUDGET: N/A <br />RECOMMENDATION: Approve the attached assignment of the Agreement from Habitat to April <br />Cash. <br />
