There was an omission where the southeast comer of the home was built at 3.4 feet instead <br />of 5 feet from the property line. <br />2. The lot has been re -plated to rectify error. The existing utility easement on the east side of <br />the lot has been reduced from 7.5 feet to 2.5 feet and located a new 15 feet utility easement <br />to the west side of property. <br />3. The request for variance is in harmony with the general purposes and intent of area <br />regulations for single-family buildings in residential districts contained in the Zoning <br />Ordinance 1710 Subsection 9-600-602 and will protect the character of the immediate <br />vicinity of the area. <br />4. There are special or unique condition(s) of restricted area, such as utility easement and <br />angled side property line, or shape, that exist on the subject parcel of land that cause <br />unusual and practical difficulty or unnecessary hardship in compliance with the provisions <br />sought here to be varied. <br />5. The hardship sought to be avoided is not the result of (a) the applicant's own actions (self- <br />imposed or self-created) and may cause (b) economic or financial "hardship." to the <br />applicants, if the application is denied. <br />6. The provision of the ordinance regulation that is sought to be varied, may deprive the <br />applicant of reasonable rights to use property that are commonly enjoyed by other <br />residential properties in the SF -2 Residential Zoning District which are required to comply <br />with these same ordinance provisions. <br />4. Public hearing to consider and take action on the petition of Theodore Henderso <br />'I <br />regarding a variance to the City of Paris 4ccessory Building Regulations, Section 133 <br />101 (c), on Lot 4, Block J, of the Morningside Estates, being located at 845 SE 39th Street <br />David Hamilton opened the public hearing. <br />Director of Planning and Zoning, Osei Amo-Mensah presented case to board and gave City <br />recommendation. Osei mentioned that corrections have been made to satisfy zoning <br />0 <br />setback requirements. <br />Theodore Henderson, applicant, stated that after speaking with the City about setbacks in <br />relation to fire safety since the building is non-combustible he believes he is able to satisfy <br />any concerns on that matter. <br />No one else spoke in favor or opposition of the request. <br />Public hearing was declared closed. <br />Motion was made by Harley Draven, seconded by Ben Vaughan to approve the variance <br />to the City of Paris Accessory Building Regulations based on the following findings. <br />Motion carried 5 ayes - 0 nays. <br />0 <br />FINDINGS. <br />1. The required accessory structure to main building separation distance cannot be met. <br />
