DOM <br />..... ....... <br />The undersigned is an agent for Lone Star Planned Developments, LLC ("Develo 9') and <br />requests payment to Developer (or to the person designated by Developer) from the applicable <br />account of the PID Project Fund from (the "Trustee") in the amount of <br />to be transferred from the applicable account of the PID Project <br />Fund upon the delivery of the PID Bonds for costs incurred in the establishment, administration, <br />and operation of Forestbrook Public Improvement District No. I (the "District") and costs <br />associated with the issuance of PID Bonds, as follows. <br />Unless otherwise defined, any capitalized terms used herein shall have the meanings ascribed t <br />them in the Indenture of Trust by and between the City and the Trustee dated as of (th <br />"Indenture") relating to the (the "PID Bonds"). <br />In connection with the above referenced payment, Developer represents and warrants to the City <br />as follows-. <br />1. The undersined is a duly authorized officer of Developer, is qualified to e <br />gxecut <br />this Closing Disbursement Request on behalf of Developer, and is knowledgeable as to the mattero, <br />set forth herein. I <br />2. The payment requested for the below referenced establislu-nent, administration, and <br />operation of the District at the time of the delivery of the PID Bonds have not been the subject of <br />any phor payment request submitted to the City. <br />3. The amount listed for the below costs is a true and accurate representation of th <br />PID Project Costs associated with the establishment, administration and operation of the Distri <br />at the time of the delivery of the PID Bonds, and such costs are in compliance with the Servic <br />and Assessment Plan. I <br />4. Developer is in compliance with the terms and provisions of the Reimburseme <br />Agreement, the Bond Indenture, and the Service and Assessment Plan. 1 <br />5. All conditions set forth in the Indenture and the Reimbursement Agreement for th <br />payment hereby requested have been satisfied. I <br />6. Developer agrees to cooperate with the City in conducting its review of th <br />requested payment, and agrees to provide additional information and documentation as i <br />reasonably necessary for the City to complete said review.
