The undersigned is an agent for Lone Star Planned Developments, LLC ("Develo 9') and requests payment to Developer (or to the person designated by Developer) from the applicable account of the PID Project Fund from (the "Trustee") in the amount of to be transferred from the applicable account of the PID Project Fund upon the delivery of the PID Bonds for costs incurred in the establishment, administration, and operation of Forestbrook Public Improvement District No. I (the "District") and costs associated with the issuance of PID Bonds, as follows. Unless otherwise defined, any capitalized terms used herein shall have the meanings ascribed t them in the Indenture of Trust by and between the City and the Trustee dated as of (th "Indenture") relating to the (the "PID Bonds"). In connection with the above referenced payment, Developer represents and warrants to the City as follows-. 1. The undersined is a duly authorized officer of Developer, is qualified to e gxecut this Closing Disbursement Request on behalf of Developer, and is knowledgeable as to the mattero, set forth herein. I 2. The payment requested for the below referenced establislu-nent, administration, and operation of the District at the time of the delivery of the PID Bonds have not been the subject of any phor payment request submitted to the City. 3. The amount listed for the below costs is a true and accurate representation of th PID Project Costs associated with the establishment, administration and operation of the Distri at the time of the delivery of the PID Bonds, and such costs are in compliance with the Servic and Assessment Plan. I 4. Developer is in compliance with the terms and provisions of the Reimburseme Agreement, the Bond Indenture, and the Service and Assessment Plan. 1 5. All conditions set forth in the Indenture and the Reimbursement Agreement for th payment hereby requested have been satisfied. I 6. Developer agrees to cooperate with the City in conducting its review of th requested payment, and agrees to provide additional information and documentation as i reasonably necessary for the City to complete said review.
