"Authorized Improvements" means the costs and improvements authorized by Section 372.003 <br />of the PID Act, and described in Sections IIIA and III.B, as further depicted on Exhibits G-1 and <br />G-2. <br />"Bond Issuance Costs" means the costs associated with issuing PID Bonds, including, but not <br />limited to, attorney fees, financial advisory fees, consultant fees, appraisal fees, printing costs, <br />publication costs, capitalized interest, reserve fund requirements, underwriter's discount <br />(including the fee of counsel to the underwriter), fees charged by the Texas Attorney General, <br />and any other cost or expense incurred by the City directly associated with the issuance of any <br />series of PID Bonds. <br />"City" means the City of Paris, Texas. <br />"City Council" means the governing body of the City. <br />"County" means Lamar County, Texas. <br />"Delinquent Collection Costs" mean costs related to the foreclosure on Assessed Property and <br />the costs of collection of delinquent Assessments, delinquent Annual Installments, or any other <br />delinquent amounts due under this Service and Assessment Plan, including penalties and <br />reasonable attorney's fees actually paid, but excluding amounts representing interest and <br />penalty interest. <br />"Developer" means, Lone Star Planned Development, LLC, and any successors or assigns thereof <br />that intends to develop the property in the District for the ultimate purpose of transferring title <br />to end users. <br />"District" means the Forestbrook Public Improvement District No. 1 containing approximately <br />59.621 acres located within the corporate limits of the City, and more specifically described in <br />Exhibit 1-1 and depicted on Exhibit A-1. <br />"Engineer's Report" means the report provided by a licensed professional engineer that <br />describes the Authorized Improvements, including their costs, location, and benefit, and is <br />attached hereto as Appendix A. <br />"Estimated Buildout Value" means the estimated value of an Assessed Property with fully <br />constructed buildings, as provided by the Developer and confirmed by the City Council, by <br />considering such factors as density, lot size, proximity to amenities, view premiums, location, <br />market conditions, historical sales, builder contracts, discussions with homebuilders, reports <br />from third party consultants, or any other factors that, in the judgment of the City, may impact <br />value.
