A = the Assessment for the newly subdivided Lot <br />B = the Assessment for the Parcel prior to subdivision <br />C = the sum of the Estimated Buildout Value of all newly subdivided Lots with the <br />sa me Lot Type <br />D = the sum of the Estimated Buildout Value for all of the newly subdivided Lots <br />excluding Non -Benefitted Property <br />E= the number of newly subdivided Lots with the same Lot Type <br />Prior to the recording of a subdivision plat., the Developer shall provide the City an <br />Estimated Buildout Value as of the date of the recorded subdivision plat for each Lot <br />created by the recorded subdivision plat. The calculation of the Assessment for a Lot shall <br />be pe rf ormed by the Ad m i n 1 strator a nd conf i rm ed by th e City Co u nci I based on Esti mated <br />Buildout Value information provided by the Developer, homebuilders, third party <br />consultants, and/or the official public records of the County regarding theThe <br />Estimated Buildout Value for Lot Type I is shown on Exhibit E and will not change in future <br />Annual Service Plan Updates. The calculation as confirmed by the City Council shall be <br />conclusive and binding. <br />The sum of the Assessments for all newly subdivided Lots shall not exceed the Assessment <br />for the portion of the Assessed Property subdivided prior to subdivision. The calculation <br />shall be made separately for each newly subdivided Assessed Property. The reallocation <br />of an Assessment for an Assessed Property that is a homestead under Texas law may not <br />exceed the Assessment prior to the reallocation. Any reallocation pursuant to this section <br />shall be reflected in the Annual Service Plan Update immediately following such <br />reallocation. <br />If two or more Lots or Parcels are consolidated into a single Lot or Parcel, the <br />Administrator shall allocate the Assessments against the Lots or Parcels before the <br />consolidation to the consolidated Lot or Parcel, which allocation shall be approved by the <br />City Council in the next Annual Service Plan Update immediately following such <br />consolidation. The Assessment for any resulting Lot may not exceed the Maximum <br />Assessment for the applicable Lot Type and compliance may require a mandatory <br />Prepayment of Assessments pursuant to Section VII.C. <br />B. Mandatory Prepayment of Assessments <br />If an Assessed Property or a portion thereof is conveyed to a party that is exempt from payment <br />of the Assessment under applicable law, or the owner causes a Lot, Parcel or portion thereof to <br />FORESTBROOK PUBLIC IMPROVEMENT DISTRICT NO. 1 18 <br />SERVICE AND ASSESSMENT PLAN <br />
