The Administrator shall prepare and submit to the City Council for its review and approval an <br />Annual Service Plan Update to allow for the billing and collection of Annual Installments. Each <br />Annual Service Plan Update shall include updated Assessment Rolls and updated calculations of <br />Annual Installments. The Annual Collection Costs for a given Assessment shall be paid by the <br />owner of each Parcel pro rata based on the ratio of the amount of outstanding Assessment <br />remaining on the Parcel to the total outstanding Assessment. Annual Installments shall be <br />reduced by any credits applied under an applicable Indenture, such as capitalized interest, <br />interest earnings on account balances, and any other funds available to the Trustee for such <br />purposes. Annual Installments shall be collected by the City in the same manner and at the same <br />time as ad valorem taxes. Annual Installments shall be subject to the penalties, procedures, and <br />foreclosure sale in case of delinquencies as set forth in the PID Act and in the same manner as ad <br />valorem taxes due and owing to the City. To the extent permitted by the PID Act or other <br />applicable law, the City Council may provide for other means of 11! <br />Annual Installments, <br />but in no case shall the City take any action, or fail to take any action, thwould cause it to be <br />in default under any Indenture. Assessments shall have the lien priority specified in the PID Act. <br />Sales of the Assessed Property for nonpayment of Ann u a I I nsta I I mentssha I I be subject to the I ien <br />for the remaining unpaid Annual Installments against the Assessed Property, and the Assessed <br />Property may again be sold at a judicial foreclosure sale if the purchaser fails to timely pay any of <br />the remaining unpaid Annual Installments as they become due and payable. <br />The City reserves the right to refund PID Bonds in accordance with applicable law, including the <br />PID Act. In the event of a refunding, the Administrator shall recalculate the Annual Installments <br />so that total Annual Installments will be sufficient to pay the refunding bonds, and the refunding <br />Each Annual Installment of an Assessment, including interest on the unpaid principal of the <br />Assessment, shall be updated annually. Each Annual Installment shall be due when billed and <br />shall be delinquent if not paid prior to February I of the following year. The initial Annual <br />Installments of the Improvement Area #1 Assessments shall be due when billed and shall be <br />delinquent if not paid prior to February 1, 2026. <br />Failure of an owner of an Assessed Property to receive an invoice for an Annual Installment shall <br />not relieve said owner of the responsibility for payment of the Assessment. Assessments, or <br />Annual Installments thereof, that are delinquent shall incur Delinquent Collection Costs. <br />G.
