Amendments to this Service and Assessment Plan must be made by the City Council in <br />accordance with the PID Act. To the extent permitted by the PID Act., this Service and Assessment <br />Plan may be amended without notice to owners of the Assessed Property: (1) to correct mistakes <br />and clerical errors; (2) to clarify ambiguities; and (3) to provide procedures to collect <br />Assessments, Annual Installments, and other charges imposed by this Service and Assessment <br />Plan. <br />f Ty 6=1 <br />The Administrator shall: (1) perform the obligations of the Administrator as set forth in this <br />Service and Assessment Plan; (2) administer the District for and on behalf of and at the direction <br />of the City Council; and (3) interpret the provisions of this Service and Assessment Plan. <br />Interpretations of this Service and Assessment Plan by the Administrator shall be in writing and <br />shall be appealable to the City Council by owners of Assessed Property adversely affected by the <br />interpretation. Appeals shall be decided by the City Council after holding a public meeting at <br />which all interested parties have an opportunity to be heard. Decisions by the City Council shall <br />be final and binding on the owners of Assessed Property and developers and their successors and <br />assigns. <br />D. Form of Buyer Disclosure/Filling Requirement -2 <br />Per Section 5.014 of the Texas Property Code, as amended, this Service and Assessment Plan, and <br />any future Annual Service Plan Updates, shall include a form of the buyer disclosures for the Lot <br />types with the District. The buyer disclosures are attached hereto as Appendix B. Within seven <br />days of approval by the City Council, the City shall file and record in the real property records of <br />the County the executed ordinance of this Service and Assessment Plan, or any future Annual <br />Service Plan Updates. The executed ordinance, including any attachments, approving this Service <br />an Assessment Plan or any future Annual Service Plan Updates shall be filed and recorded in their <br />If any provision of this Service and Assessment Plan is determined by a governmental agency or <br />court to be unenforceable, the unenforceable provision shall be deleted and, to the maximum <br />extent possible, shall be rewritten to be enforceable.
