D. A group, including a faith -based group, that enters into a financial or non-financial agreement <br />with a health or human services agency to provide services to that agency's clients; <br />E® A local workforce development board created under Section 2308.253, Texas Government Code; <br />F. A nonprofit organization approved by the Supreme Court of Texas that provides free legal <br />services for low-income households in civilmatters; <br />Cl. The Texas Boll Weevil Eradication Foundation, Inc., or an entity designated by the commissioner <br />of agriculture as the foundation's successor entity under Section 74. 1011, Texas Agriculture <br />Code; <br />H. A nonprofit computer bank that solicits, stores, refurbishes and redistributes used computer <br />equipment to public school students and their families; and <br />I. A nonprofit organization that provides affordable housing. <br />3.5 Business day <br />Shall mean business days, Monday through Friday, except for State and Federal holidays. If the Contract <br />calls for performance on a day that is not a business day, then performance is intended to occur on the <br />next business day. <br />3.6 DIR <br />Refers to the Texas Department of Information Resources. <br />3.7 Effective Date <br />Refers to the effective date of the Contract as set forth therein. <br />3.8 Invoice <br />Refers to a Customer approved instrument submitted by Successful Respondent for payment of services. <br />3.9 Purchase Order <br />Refers to Customer's fiscal form or format, contract with Successful Respondent, or other document used <br />by Customer to authorize the purchase of products or services from Successful Respondent under the <br />Contract, including but not limited to a formal written purchase order, procurement card, electronic <br />purchase order, or another authorized instrument. <br />3.10 State <br />Refers to the State of Texas. <br />3.11 Statement of Work (SOW) <br />Means a document entered into between Customer and Successful Respondent describing a specific set of <br />activities and/or deliverables, which may include Work Product and Intellectual Property Rights, that <br />Successful Respondent is to provide Customer, issued pursuant to the Contract. <br />3.12 Subcontracting Plan <br />Refers to Appendix B, Successful Respondent's Historically Underutilized Business Subcontracting <br />Plan. <br />3.13 Successful Respondent <br />Refers to the party identified as either "Successful Respondent" or "Vendor" in Section 1.1 of the <br />Contract. <br />Appendix A Standard Contract Terms and Conditions Page 6 <br /><Rev December 2021> <br />
