Amendment Number 1 <br />to <br />Contract Number DIR-CPO-5688 <br />between <br />State of Texas, acting by and through the Department of Information Resources <br />and <br />IMMIXTECHNOLOGY, INC. <br />This Amendment Number 1 ("Amendment") to Contract Number DIR-CPO-5688 <br />("Contract") is between the Department of Information Resources (hereinafter "DIR") and <br />IMMIXTECHNOLOGY, INC. (hereinafter "Successful Respondent"). DIR and "Successful <br />Respondent" agree to modify the terms and conditions of the Contract as follows: <br />1. Appendix A, Standard Contract Terms and Conditions Sections 10.4(B)(xxv) replaced <br />in its entirety with the following: <br />xxv) neither it, nor its holding companies or subsidiaries, is: <br />(a) Listed in Section 889 of the 2019 National Defense Authorization Act; <br />(b) Listed in Section 1260H of the 2021 National Defense Authorization Act; or <br />(c) Owned by the government of a country on the U.S. Department of Commerce's <br />foreign adversaries list under 15 C.F.R Section 791.4; or <br />(d) Controlled by any governing or regulatory body located in a country on the U.S. <br />Department of Commerce's foreign adversaries list under 15 C.F.R Section 791.4; and <br />xxvi) all information provided by "Successful Respondent is current, accurate, and <br />complete. <br />All other terms and conditions of the Contract as amended, not expressly amended herein, <br />shall remain in full force and effect.
