DECISION OF THE BOARD OF ADJUSTMENT, CITY OF PARIS, TEXAS <br />RE: Variance Request- Parcel 129233 <br />Invest Fannin LLC <br />Attn: Zachary Bergenholtz <br />PO Box 797111 <br />Dallas, TX 75460 <br />ACTION REQUESTED: 15' Vari ance to 25' Build line on the west side of the property, SE 6t, <br />Street Frontage, as indicated on Plat. <br />The above -reference request was approved by the City of Pan*s Zoning Board of Adjustment <br />("Board") on 10/07/2025 by a vote of ayesnays and abstaini'ng. <br />------------ <br />On this date, the Board found that the request met the conditions set forth by the plat filed with the <br />Lamar County Clerk 'in October of 202 1. <br />Appeal: Any interested person wishing to appeal this Board decision is required to file a petition <br />for Writ of Certiorari in a district court, county court or county court at law within ten (10) days <br />of the date this decision is filed in the Board's office consistent with section 211.011 of the Texas <br />Local Government Code. <br />The Board of Adjustment hereby approves the variance request based upon the following findings. <br />FINDINGS <br />1. The lot is platted. <br />2. The proposed residential structure of 1,440 square feet in the Two -Family Dwelling -(2F) <br />creates a hardship to meet the required minimum street front setbacks of 25 SF each per <br />City of Pan's Area Regulations, Section 9-501 (1). <br />3. lnvan*ably, the Zoning Ordinance 1710 Section 9-602. (5) makes provision for such <br />variance situation and request to meet the minimum required front and side yards setback <br />per the code. The request, 'if approved will be 'in hannony with the general purposes and <br />intent of area regulations for residential bungs and lot regulations in Two-Farnily <br />Dwelling -(2F) contained in and will protect the character of the inunediate vicinity of the <br />area. <br />4. There are no special or unique condition(s) of restricted area, such as the utility casement <br />that exists on the subject parcel of land that causes unusual and practical difficulty or <br />unnecessary hardship in compliance with the provisions sought here to be varied, other <br />than a comer lot that requires two front yard setbacks issue that cannot be met, <br />irrespectively. <br />5.
