Oil <br />40 -foot ROW for NW 16 Street. The proposed home to be constructed on each of the four <br />lots will be less than 30 feet wide. The narrow -width proposed house meets all the other <br />zoning requirements. <br />3. Invariably, apart from the Zoning Ordinance 1710 Section 9-201. (1) that refers to lot <br />width, the proposed lots meet the minimum required length, front and side yards setback <br />per the code. The request, if approved will be in harmony with the general purposes and <br />intent of area regulations for residential buildings and lot regulations in Single -Family <br />Dwelling -(SF -3) District contained in and will protect the character of the immediate <br />vicinity of the area. <br />4. There are no special or unique condition(s) of restricted area, that exists on the subject <br />parcel of land that causes unusual and practical difficulty or unnecessary hardship in <br />compliance with the provisions sought here to be varied, other than the five foot ROW <br />dedication that was required on the east side of Lot 4 that has created lot width issue that <br />cannot be met, irrespectively. <br />5. The hardship sought to be avoided is not necessarily the result of (a) the applicant's own <br />actions (self-imposed. or self-created) due to the fact that the original Maxey Addition plat <br />was approved by the City of Paris that included a 40 -foot ROW width and that the plat was <br />approved by the City of Paris the minimum ROW width that was increased from 40 -feet to <br />50 feet and may cause (b) economic or financial "hardship" should the application be <br />denied. <br />6.
