TO: Mayor, Mayor Pro -Tem, & City Council, Ms. Rose Beverly, City Manager FROM: Steve Hodges, Engineering Manager SUBJECT: Repeal of the contract with Superior Equipment Solutions for the 28th NW Sewer Main Improvements DATE; March 9, 2026 BACKGROUND: At the February 23, 2026, City Council meeting, a contract was awarded to Superior Equipment Solutions, LLC in the amount of $575,000.00 for the 281h Street NW Sewer Main Improvements Project. STATUS OF ISSUE: Subsequently, it was learned that easement acquisition for this project was not complete. City Staff was informed by the grant administrator that moving forward could jeopardize the grant. Upon discussion between City Staff, Hayter Engineering and GrantWorks, it was decided the best action would be to repeal the former action and upon completion of easement acquisition, bring this item back to the Council for approval. GrantWorks has compiled all acquisition documents and as of March 3, 2026, were in the process of hand -delivering them to the property owners. It is anticipated that this task will be completed by the end of the month. Hayter Engineering will or has been in contact with the contractor regarding the status. BUDGET: When approved, the project will be paid from TxCDBG grant funds in the amount of $500,000.00 and the City's match of $75,000.00. Hayter Engineering has verified the accuracy and completeness of their bid and found all references to have provided positive feedback about the company's work performance and capabilities. RECOMMENDATION: Repeal the action taken at the February 23, 2026, City Council meeting, awarding a contract to Superior Equipment Solutions, LLC.
