(3) Backflow prevention assemblies installed on irrigation systems that are not <br />classified as health hazards must be tested every 2 years or as required by the <br />adopted plumbing code. <br />(j) Appeal. A person may appeal the decision of the director or regulatory authority by <br />making a written request for appeal to the appeals officer within seven (7) business <br />days of the adverse decision or action. The appeal hearing shall be conducted no later <br />than seven (7) business days following receipt of the notice of appeal unless the parties <br />agree to a later date. The appeal shall be conducted by to the building board of appeals. <br />The decision of the building board of appeals shall be final. <br />(k) Enforcement. A person who violates any provision of this article by performing a <br />prohibited act or by failing to perform a required act is guilty of a misdemeanor and, <br />upon conviction, shall be punished by a fine of not less than $500.00 and not more than <br />$2,000.00. Each day that one or more of the provisions in this article is violated shall <br />constitute a separate offense. If a person is convicted of two (2) or more distinct <br />violations of this article, the building safety department shall, upon due notice to the <br />customer, be authorized to discontinue water service to the premises where such <br />violations occur. Services discontinued under such circumstances shall be restored only <br />upon payment of a reconnection charge, hereby established at $150.00, and any other <br />costs incurred by the city in discontinuing service. In addition, suitable assurance must <br />be given to the building safety department that the same action shall not be repeated <br />while the article is in effect. Compliance with this article may also be sought through <br />injunctive relief in district court. <br />§ 4.02.125. through § 4.02.150. (Reserved) <br />DIVISION 6 <br />Fuel Gas Code <br />§ 4.02.151. Adopted. <br />(a) Definition. For purposes of this division, "fuel gas code" shall mean the 2021 2024 <br />International Fuel Gas Code (sometimes referred to as the IFGC) including any and all <br />amendments, revisions or revised additions to the 2021 2024 International Fuel Gas <br />Code. <br />(b) Adoption. The 2021 2024 International Fuel Gas Code, including appendices A, B, C <br />and D (which are informational only and which shall only be used for reference), is <br />hereafter adopted as the municipal fuel gas code for the city. The 2021 2024 <br />International Fuel Gas Code shall apply to regulation and governance of fuel gas <br />systems and gas-fired appliances as herein provided; providing for the issuance of <br />permits and collection of fees therefor; and providing for the regulations, provisions, <br />penalties, conditions and terms set forth therein. <br />
