ORDINANCE NO. 2026-025 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, <br />TEXAS, AMENDING ZONING ORDINANCE NO. 1710 BY REPEALING <br />SUBSECTION 29, "REQUIRED COMPONENTS REGARDING SOLAR <br />FARM SPECIFIC USE PERMITS (SUP)," AND ADOPTING A NEW <br />SUBSECTION 29 ESTABLISHING ZONING REGULATIONS FOR <br />UTILITY -SCALE SOLAR ENERGY FACILITIES; AMENDING SECTIONS <br />8-100, 8-103, AND 12-100 TO PROVIDE CONFORMING <br />AMENDMENTS; PROVIDING THAT UTILITY -SCALE SOLAR ENERGY <br />FACILITIES MAY BE CONSIDERED ONLY BY SPECIFIC USE PERMIT <br />(SUP) WITHIN THE LIGHT INDUSTRIAL (LI) AND HEAVY INDUSTRIAL <br />(HI) ZONING DISTRICTS; ADOPTING BY REFERENCE THE CITY OF <br />PARIS DEVELOPMENT STANDARDS MANUAL DSM -001 - UTILITY - <br />SCALE SOLAR ENERGY FACILITIES, ATTACHED AS EXHIBIT A; <br />PROVIDING FOR ADMINISTRATION; PROVIDING A REPEALER <br />CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A <br />SEVERABILITY CLAUSE; PROVIDING A PENALTY CLAUSE; AND <br />PROVIDING AN EFFECTIVE DATE. <br />WHEREAS, the City of Paris is a home -rule municipality operating under the <br />Constitution and laws of the State of Texas and possesses authority to regulate zoning, <br />land use, development, public infrastructure, subdivision, utilities, construction, fire <br />safety, and related matters within its jurisdiction to protect the public health, safety, and <br />welfare; and <br />WHEREAS, the City has adopted Zoning Ordinance No. 1710, codified as <br />Chapter 9, Exhibit 913, "Zoning Ordinance," of the Code of Ordinances of the City of <br />Paris, Texas, which regulate the use of land, buildings, structures, and premises within <br />the City; and <br />WHEREAS, Utility -Scale Solar Energy Facilities constitute a distinct land use due <br />to their scale, land consumption, operational characteristics, infrastructure demands, <br />long-term maintenance obligations, decommissioning obligations, visual impacts, <br />drainage considerations, emergency response considerations, and potential effects on <br />surrounding properties and future community development; and <br />WHEREAS, the City Council finds that Utility -Scale Solar Energy Facilities <br />should not be classified by default as agricultural uses, public utilities, electrical <br />substations, accessory solar systems, general industrial uses, or ordinary commercial <br />uses; and <br />
