<br />RESOLUTION NO. 2006-012 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, <br />PARIS, TEXAS, PROVIDING THAT AT LEAST ONE ACCESSIBLE <br />VOTING SYSTEM WILL BE IN EACH POLLING PLACE USED IN A <br />TEXAS ELECTION ON OR AFTER JANUARY 1, 2006, PURSUANT TO <br />SECTION 61.012 OF THE TEXAS ELECTION CODE; MAKING OTHER <br />FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, in accordance with Section 61.012 ofthe Texas Election Code the City of <br />Paris must provide at least one accessible voting system in each polling place used in a Texas <br />election on or after January 1, 2006. The system must comply with state and federal laws <br />setting the requirements for voting systems that permit voters with physical disabilities to cast <br />a secret ballot; and, <br /> <br />WHEREAS, The Office of the Texas Secretary of State has certified that the AutoMark <br />V oter Assist Terminal Version 1.0 provided by Election Systems and Software is an accessible <br />voting system that may legally be used in Texas elections; and, <br /> <br />WHEREAS, Sections 123.032 and 123.035 of the Texas Election code authorize the <br />acquisition of voting systems by local political subdivisions and further mandate certain minium <br />requirements for contracts relating to the acquisition of such voting systems; NOW, <br />THEREFORE, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, <br />TEXAS: <br /> <br />Section 1. That the findings set out in the preamble to this resolution are hereby in all <br />things approved. <br /> <br />Section 2. That the City Clerk, as chief elections officer of the City of Paris, shall provide <br />at least one AutoMark Voter Assist Terminal Version 1.0 in each polling place in every polling <br />location used to conduct any election ordered on or after January 1,2006. <br /> <br />Section 3. That the AutoMark Voter Assist Terminal Version 1.0 may be acquired by <br />any legal means available to the City of Paris, including but not limited to lease or rental from <br />the County of Lamar or from any other legal source, as authorized by Sections 123.032 and <br />123.035, Texas Election Code. <br /> <br />Section 4. That this resolution shall be effective from and after its date of passage. <br />
