<br />RESOLUTION NO. g4-048 <br /> <br />WHEREAS, the City Council of the City of Paris did heretofore in Ordinance No. 93-018 <br />close Old Paris-Clarksville Road, beginning at a point in the south right-of-way line of U. S. <br />Highway No. 271 (Clarksville Street) approximately 109 feet east of the Northwest corner of Lot 9, <br />City Block 311 and proceeding in an easterly direction approximately 1333.18 feet to the east <br />boundary line of Lot 13, City Block 311; and, <br /> <br />WHEREAS, the City Council of the City of Paris did heretofore in Resolution 93-079 did <br />authorize the acquisition of the State's roadside park-site property, located north of said abandoned <br />Old Paris-Clarksville Road, in the amount of $2,548.00 for its conveyance to landowners abutting <br />Old Paris-Clarksville Road to the south; and, <br /> <br />WHEREAS, the City now has possession of said State's surplus property and is in a position <br />to sell said roadside park-site property to the landowners abutting Old Paris-Clarksville Road to the <br />south to provide their access to U. S. Highway 271 at cost and on a pro rata basis as follows: <br /> <br />Lot 10 .0109 acres $ 23.87 <br />Lot 11 .3962 acres $ 867.35 <br />Lot 12 .2807 acres $ 641.51 <br />Lot 14 .4761 acres $1.042.27 <br />TOTAL 1.1639 acres $2,548.00; and, <br /> <br />WHEREAS, it is appropriate that the abandoned and closed street right-of-way adjacent to <br />Lots 9, 10, 11, 12 and part of 14, City Block 311 has no utility except to the adjacent owners and, <br />therefore, the abandoned right-of-way should be conveyed to the adjacent owners in accordance with <br />the laws of the State of Texas; NOW, THEREFORE, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the Mayor <br />of the City of Paris, Don Shelton be, and he is hereby authorized to execute special warranty deeds <br />for the portion of the property formerly established as State's roadside park-site property and the <br />abandoned Old Paris-Clarksville right-of-way to the abutting landowners to the South, it appearing <br />that the real and true owners of the hereinafter described lots are as follows: <br /> <br />Lot 9 Charles A. Endsley, Jr: Old Paris-Clarksville Road Right-of-Way Only <br /> <br />Lot 10 J. D. LaFoy: Roadside Park-Site Property and Road Right-of-Way <br /> <br />Lot 11 Springlake Baptist Church: Roadside Park-Site Property and Road Right-of-Way <br /> <br />Lot 12 Margie E. Barham: Roadside Park-Site Property and Road Right-of-Way <br /> <br />Lot 14 Larry Greb: Roadside Park-Site Property and Road Right-of-Way <br /> <br />BE IT FURTHER RESOLVED, that the City of Paris retain a utility easement in the area to <br />be described in the above described special warranty deeds. <br /> <br />PASSED AND ADOPTED the 9th day of May, 1994. <br /> <br />ATTEST: <br /> <br />
