Managements Standards (UGCMS) developed under the direc- <br />tive of the Uniform Grant and Contract Management Act, Chapter 183, Government Code. <br />16. It, if a county, has taken or will take all action necessary to provide the Texas Department of Criminal Justice and the <br />Department of Public Safety any criminal history records maintained by the county in the manner specified for the pur- <br />poses of those departments. <br />17. It will comply with Title VI of the Civil Rights Act of 1964,42 U.S.C. 20004 (prohibiting discrimination on the basis of <br />race, color, ornational origin), Section 504 of the Rehabilitation Act of 1964,42 U.S.C., 794 (prohibiting discrimination <br />on the basis of handicap), the Age Discrimination Act of 1975, 42, U.S.C. 6101, et seq., and the Department of Justice <br />Nondiscrimination Regulations, 28 CFR, Part 42, Subparts C, D, and G. <br />18. It will, in the event a federal or state court or federal or state administrative agency makes a finding of discrimination after <br />a due process hearing, on the ground of race, color, religion, national origin, sex, age, or handicap against the project, <br />forward a copy of the finding to the Criminal Justice Division (CJD). <br />19. It will comply with Subtitle A, Title II of the Americans With Disabilities Act (ADA), 42 U.S.0 12131 - 12134, and <br />Department of Justice implementing regulation, 28 CFR Part 35, whereas state and local governments may not refuse to <br />allow a person with a disability to participate in a service, program, or activity simply because the person has a disability. <br />20. Cities and counties will comply with the following sections of the Juvenile Justice and Delinquency Prevention Act, U.S.C. <br />5671, as amended. <br />21. (a) (12) (A), regarding removal of status offenders from secure facilities. <br />22. (a) (13), regarding sight -and -sound separation of juveniles from adults when detained in the same secure facility. <br />23. (a) (14), regarding removal of juveniles from adult jails and lockups. <br />24. It will comply with the provisions of the Hatch Act which limit the political activity of employees. <br />25. It will comply, and assure the compliance of all its contractors, with the applicable provisions ofTitle I of the Omnibus <br />Crime Control and Safe Streets Act of 1968, as amended, the Juvenile Justice and Delinquency Prevention Act, or the <br />Victims of Crime Act, as appropriate; the provisions of the current edition of the Office of Justice Programs Financial <br />Guide and all other applicable federal laws, circulars, or regulations. <br />26. It will comply with the provisions of 28 CFR applicable to grants and cooperative agreements including Part 18, Adminis- <br />trative Review Procedure; Part20, Criminal Justice Information Systems; Part 22, Confidentiality of Identifiable Research <br />and Statistical Information; Part 23, Criminal Intelligence Systems Operating Policies; Part 30, Intergovernmental Review <br />of Department of Justice Programs and Activities; Part 42, Nondiscrimination /Equal Opportunity Policies and Procedures; <br />Part 61, Procedures for Implementing the National Environmental Policy Act; Part 63, Floodplain Management and <br />Wetland Protection Procedures; and federal laws or regulations applicable to federal assistance programs. <br />27. It will comply, and all its contractors will comply, with the nondiscrimination requirements of the Omnibus Crime and Safe <br />Streets Act of 1968, as amended, 42 U.S.C. 3789(4), the Juvenile Justice and Delinquency Prevention Act, or the Victims <br />of Crime Act (as appropriate); Title VI of the Civil Rights Act of 1964, as amended; Section 504 of the Rehabilitation Act <br />of 1973, as amended; Subtitle A, Title 1I of the Americans with Disabilities Act of 1990; Title IX of the Education Amend- <br />ments of 1972; the Age Discrimination Act of 1975; Department of Justice Non - Discrimination Regulations, 28 CFR Part <br />42, Subparts C, D, E, and G; and the Department of Justice regulations on disability discrimination, 28 CFR Part 35 and <br />Part 39. <br />28. It will provide an Equal Opportunity Program if required to maintain one, where the app] ication is for $500,000 or more. ;; N <br />29.
