<br />23. That LESSOR may at its option terminate this lease as <br />to the entire hangar building, or any part thereof, which may be <br />necessary, in the event LESSOR desires to use the property, or <br />any portion thereof, for necessary municipal functions, such as <br />extension of runways or erection of other airport facilities. In <br />the event of either of the above contingencies LESSOR shall give <br />the LESSEE ninety (90) days notice in writing of its intention to <br />utilize the building or any part thereof. In the event this <br />option is exercised by the LESSOR, all rental payments collected <br />under this lease shall be refunded to LESSEE, and LESSEE shall be <br />paid his costs of any improvements authorized by LESSOR and made <br />to said building. <br />24. During the time of war or national emergency, LESSOR <br />shall have the right to lease the landing area or any part <br />thereof to the United States Government for military or naval <br />use, and, if such lease is executed, the provisions of this <br />instrument insofar as they are inconsistent with the provisions <br />of the lease to the Government, shall be suspended. <br />25. In the event LESSEE shall keep each and every agreement <br />contained herein and do and perform all the obligations required <br />of LESSEE hereunder during the term of this lease, an option is <br />hereby given and granted to LESSEE to renew and extend this lease <br />for an additional period of five (5) years from and after the <br />expiration of this agreement at a rental rate to be negotiated at <br />that time; by LESSEE giving notice in writing of LESSEE'S <br />intention to renew said lease on or before the 1st day of <br />December, 1994. <br />26. The terms of this lease are binding on and the benefits <br />herein inure to the heirs, administrators and executors of <br />LESSEE. <br />
