<br />UTILITY EASEMENT <br /> <br />STATE OF TEXAS ~ <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />COUNTY OF LAMAR ~ <br /> <br />That the City of Paris, Paris, Texas, a municipal corporation, of Lamar County, Texas, <br /> <br />having an address at P. O. Box 9037, Paris, Texas 75461 ("Grantor"), acting by and through its <br /> <br />Mayor, duly authorized, for and in consideration of the sum of Ten Dollars ($10.00) cash, and other <br /> <br />good and valuable consideration, to it in hand paid by Panda Paris Power, L.P., a Delaware limited <br /> <br />partnership, having an address at 4100 Spring Valley Road, Suite 1001, Dallas, Texas 75244 <br /> <br />("Grantee"), the receipt and sufficiency of which is hereby acknowledged, does hereby sell, give, <br /> <br />and grant unto the said Panda Paris Power, L.P., a utility easement for the purpose of laying, <br /> <br />constructing, maintaining, altering, inspecting, operating, repairing, relocating, changing the size of, <br /> <br />removing, and replacing one (1) underground pipeline and the appurtenances thereto, including <br /> <br />pumps and pumping equipment, fittings, corrosion control equipment, and other above-ground and <br /> <br />below-ground apparatus and equipment (collectively, the "Pipeline "), for the transportation of water <br /> <br />and water related products which can be transported through pipelines, through the land owned by <br /> <br />Grantor, situated in Lamar County, Texas, and more particularly described on Exhibit A, attached <br /> <br />hereto, and does further give and grant a temporary construction easement described as follows: <br /> <br />BEING a strip of land fifty (50) feet in width situated within the corporate limits of the <br />City of Paris, County of Lamar and State of Texas, a part of the Redding Russell <br />Survey, Abstract No. 786, and being a 30 foot wide waterline easement across City <br />of Paris property described in deed recorded in Volume 353, Page 257, Deed Records, <br />Lamar County, Texas, said fifty-foot (50) foot temporary easement beit:lg fifty (50) <br />feet south of the south boundary line of said permanent easement. <br /> <br />L XH no"" , -:. ~ <br />( ~IO ~ (j <br />
