<br />INTRODUCTION <br /> <br />The Member recognizes that many employees in today's work force are faced with childcare expenses. In addition, . <br />the Member recognizes that certain medical or health care expenses are not fully covered by your health benefit <br />program. <br /> <br />To assist employees with these expenses, we are offering you the opportunity to participate in the Member <br />Dependent Care and Umeimbursed Health Care Expense Flexible Spending Account Plans. These Plans are part of <br />the Member Section 125 Cafeteria Plan. These spending account plans allow you to pay for dependent care and <br />health care expenses that are not or cannot be reimbursed by your health benefit program, such as the monthly <br />contributions, deductibles and the benefit percentage that is your responsibility, with before-tax dollars. This plan <br />offers you the opportunity to make contributions to flexible spending accounts to cover these expenses with before- <br />tax moneys. <br /> <br />You will be reimbursed for childcare expenses and umeimbursed health care expenses from your flexible spending <br />accounts as you present your claims for payment. <br /> <br />We have written this booklet with as few technical terms as possible, so that you will be aware of your benefit <br />rights. Every effort has been made to make the booklet as complete and accurate as possible. However, if any <br />conflict should arise between this booklet and the Plans, the terms of the Plans will govern. <br /> <br />Member will be happy to supply you with any additional information so that you will have a complete <br />understanding of the benefits. <br /> <br />GENERAL INFORMATION <br /> <br />Name and Type of Plan and Fiscal Year <br />The names of the Plans are the Member Dependent Care Healthcare Reimbursement Plan and the Member <br />Healthcare Reimbursement Account Plan. The Dependent Care Flexible Spending Account Plan is a plan authorized <br />under Section 129 of the Internal Revenue Code. The Umeimbursed Healthcare Flexible Spending Account Plan is <br />authorized under Section 105 of the Internal Revenue Code. All Plans are provided under the Member Plan, which is <br />an authorized Internal Revenue Code Section 125 Cafeteria Plan. <br /> <br />Administration of the Plan <br />The Plan Sponsor is the Member or its designated staff. <br /> <br />The Plan Supervisor is the TML Intergovernmental Employee Benefits Pool. <br /> <br />Agents for Service of Legal Process <br />Legal process may be made on the Member. <br /> <br />Amendments to or Termination of the Plan <br />The Plan may be modified, amended or terminated in whole or in part, at any time by the Member or its designee. <br /> <br />Page 4 <br />
