DRAFT f:attorney\reswork\current\ RRVFA Lease Addendum Approval Res 2006 March 20, 2006 RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, APPROVING ADDENDUM NO. ONE TO LEASE AGREEMENT WITH THE RED RIVER VALLEY FAIR ASSOCIATION, INC. DATED MARCH 10, 1997; ADDING PROPERTY FORMERLY KNOWN AS REECE FIELD BALL PARK FACILITIES TO THE FAIRGROUND PROPERTY; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Paris did heretofore, on the 10th day of March, 1997, in Resolution No. 97-024, approve the execution of a lease agreement with Red River Valley Fair Association; and, WHEREAS, the City Council ofthe City of Paris did heretofore, on the 9th day of July, 2001, in Resolution 2001-107, exercised the City's option to terminate a portion of said Lease to designate certain property at the fair grounds as the site of a new animal shelter; and, WHEREAS, the City Council, upon notice that the Boys & Girls Club of The Red River Valley, Inc. was no longer using the ball park facilities known as Reece Field and had no desire to continue their lease with the City of Paris, did on March 27, 2006 terminate said Lease Agreement with the Boys & Girls Club of The Red River Valley, Inc.; and, WHEREAS, it is deemed appropriate that the terms of the Lease Agreement with the Red River Valley Fair Association be revised by adding the property formerly known as Reece Field ball park facilities to the fairground property; and, WHEREAS, the form of Addendum No. One to said Lease Agreement, attached hereto as Exhibit A, should, in all things, be approved, and the Mayor of the City of Paris should be authorized to execute the same; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF P ARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble of this resolution are hereby in all things approved. Section 2. That the form of Addendum No. One to Lease Agreement dated March 10, 1997, with the Red River Valley Fair Association which revised the description of the property leased to the Red River Valley Fair Association, attached hereto as Exhibit A, be, and the same is hereby, approved. ,- ". -, "T.
