<br />RESOLUTION NO. 2006-106
<br />
<br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
<br />PARIS, TEXAS, APPROVING CHANGE ORDER NO. ONE AND
<br />FINAL TO CONTRACT FOR CONSTRUCTION OF WADE PARK,
<br />LAMAR A VENUE, AND 24TH STREET SE DRAINAGE PROJECT;
<br />MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE
<br />SUBJECT; AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, the City Council of the City of Paris did heretofore, on the 12th day of
<br />September, 2005, in Resolution No. 2005-107, award the contract for the "Wade Park, Lamar
<br />Avenue, and 24th Street SE Drainage Project" to Barney Bray Construction Company; and,
<br />
<br />WHEREAS, the City Engineer, acting as project engineer, recommends the
<br />amendment of the contract for said project as shown in Change Order No. One & Final, and
<br />providing for a net decrease of $28,029.46 in the contract price, for a total contract price of
<br />$942,927.54; and,
<br />
<br />WHEREAS, the form of Change Order No. One & Final, attached hereto as Exhibit
<br />A, should, in all things, be approved, and the Mayor should be authorized to execute the same;
<br />NOW, THEREFORE,
<br />
<br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
<br />TEXAS:
<br />
<br />Section 1. That the findings set out in the preamble of this resolution are hereby in
<br />all things approved.
<br />
<br />Section 2. That the form of Change Order No. One & Final to the Contract for the
<br />"Wade Park, Lamar Avenue, and 24th Street SE Drainage Project," attached hereto as Exhibit
<br />A, for the changes as shown in said Change Order No. One & Final, and providing for a net
<br />decrease of $28,029.46 in the contract price, for a total contract price of$942,927.54, be, and
<br />the same is hereby, approved.
<br />
<br />Section 3. That the Mayor be, and he is hereby, authorized and directed to execute,
<br />on behalf of the City of Paris, said Change Order No. One and Final, upon the terms and
<br />conditions and in the form shown in Exhibit A, attached hereto.
<br />
<br />Section 4. That this resolution shall be effective from and after the date of passage.
