<br />( d) The secondhand metal dealer or the dealer's agent shall visually verify the <br />accuracy of the identification presented by the seller at the time of the purchase of <br />a regulated material. <br /> <br />(e) A person commits an offense if that person, with the intent to deceive: <br /> <br />(1 ) Makes a material and false statement or representation to the <br />secondhand metal dealer in connection with the dealer's efforts to obtain <br />the information required under subsection (b) of this section; <br /> <br />(2) Displays to a secondhand metal dealer a false or invalid driver's license, <br />military identification card, passport or personal identification <br />certificate in connection with the person's attempted sale of any <br />regulated material; or <br /> <br />(3) Makes a material and false statement or representation to a secondhand <br />metal dealer in connection with that person's execution of a written <br />statement required by subsection (c)(1) or (2) of this section. <br /> <br />State law references: Similar provisions, Texas Occupations Code, Section <br />1956.010 <br /> <br />Sec. 19-33. Preservation of records. <br /> <br />Each secondhand metal dealer shall preserve the records required by Section <br />19- 32 for a period of at least three years. <br /> <br />State law references: Similar provisions, Texas Occupations Code, Section 1956- <br />006. <br /> <br />Sec. 19-34. Inspections, reports, mailing. <br /> <br />(a) On request, a secondhand metal dealer shall permit any peace officer of this <br />state to inspect, during the usual and customary business hours of the dealer, a <br />record compiled under section 19-32 and any regulated materials in the possession <br />of the dealer. The inspecting officer shall identify himself as a peace officer. <br /> <br />(b) Except as provided by subsection (c) of this section, not later that seven days <br />after the purchase or other acquisition of any material required to be recorded under <br />Section 19-32 a secondhand metal dealer must mail to or file with the city a report <br />containing the information required to be recorded in Section 19-32. <br /> <br />(c) If a secondhand metal dealer purchases any bronze material that is a cemetery <br />vase, receptacle, memorial or statuary or any aluminum irrigation pipe that can <br />reasonably be identified as aluminum irrigation pipe from a person other than the <br />
