<br />PROPOSITION 61: <br /> <br />Section 113. Recall petitions. <br /> <br />The recall petition to be effective must be returned and filed with the city clerk within <br />30 days after the filing of the affidavit required in Section 112 of this Article and it <br />must be signed <br /> <br />by qualified eleetors of the city equal in number to at least fifty one (51 %~) of the <br />total number of votes east at the last municipal election at which fORr eouBcilmen <br />were elected; provided, however, that the petitioB shall eontain the signatures of <br />at least se"/en hundred (700) qualified electors of the city <br /> <br />by qualified voters of the district of the city represented by the council member <br />whose recall is sou~ht. The number of sil!natures on the petition blanks shall be <br />in an amount equal in number to at least 51 percent of the total number of votes <br />cast at the last contested municipal election at which a council member was <br />elected from that district. or the si!!natures of at least 200 qualified voters of that <br />district. whichever is l!reater. <br /> <br />and shall conform to the provisions of Section 102 of this Article. No petition papers <br />shall be accepted as part of a petition unless it bears the signature of the city clerk as <br />required in Section 112 of this Article. <br /> <br />EXPLANATION: The recall provisions of the Charter were not updated after the <br />1976 order by U.S. District Judge William Wayne Justice requiring city councilmen <br />in Paris to run from single-member districts rather than at-large. Consequently, a <br />successful recall effort still requires the signatures of at least 700 registered voters <br />as required by the recall provision that was written in 1948, but because of the <br />court order those signatures have to come from within the district rather than <br />citywide. The result is that a successful recall petition effort is virtually impossible. <br />This amendment would require the signatures of 51 percent of the turnout in the <br />district's most recent contested election, or 200 signatures, whichever is greater. <br /> <br />PROPOSITION 62: <br /> <br />Section 114.
