<br />EXPLANATION: This would bring the city's nepotism law into agreement with <br />state law that applies only to a position that is paid directly or indirectly from public <br />funds or fees of office. Like state law, it would not apply to employees who were <br />already on the payroll for six months in the case of an elected city councilman or <br />for 30 days in the case of an appointed city councilman or a city manager. <br /> <br />PROPOSITION 66: <br /> <br />Section 135. Persons indebted to the city shall not hold office or employment. <br /> <br />No person shall be qualified to hold a municipal office or serve the city in any <br />other capacity for which compensation is paid who is, or may become while in <br />service, in arrears in the payment of taxes or other liabilities due the city. <br /> <br />EXPLANATION: This proposition would delete Section 135, which prohibits any <br />person who is in arrears to the city in payment of taxes or other liabilities. Federal <br />courts have held such a prohibition to be invalid. <br /> <br />PROPOSITIONS 67, 68, 69, 70, 71: <br /> <br />Section 149.
