<br />DRAFT <br /> <br />W:ATTORNEY\Ordwork\CurrentlFlood Plain Ordinance 2007 <br /> <br />ORDINANCE NO. <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, <br />TEXAS, AMENDING CHAPTER 13, FLOOD DAMAGE PREVENTION AND <br />CONTROL OF THE CODE OF ORDINANCES OF THE CITY OF PARIS, <br />TEXAS TO ADOPT A REVISED FLOOD DAMAGE PREVENTION <br />ORDINANCE BASED ON THE FEDERAL EMERGENCY MANAGEMENTS <br />ASSOCIATES (FEMA) MODEL FLOODPLAN MANAGEMENT <br />ORDINANCE; PROVIDING A REPEALER CLAUSE, A SEVERABILITY <br />CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING <br />AN EFFECTIVE DATE. <br /> <br />WHEREAS, the Legislature ofthe State of Texas has, in Subchapter I, Chapter 16, Section <br />16.3145 of the Texas Water Code, delegated the responsibility of local governmental units to adopt <br />regulations designed to minimize flood losses; <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF PARIS, TEXAS: <br /> <br />Section 1. That the findings set out in the preamble to this ordinance are hereby in all things <br />approved. <br /> <br />Section 2. That Chapter 13 of the Code of Ordinances of the City of Paris, Paris, Texas, <br />entitled "Flood Damage Prevention and Control," be, and the same is hereby, repealed and declared <br />null and void and or no further effect. <br /> <br />Section 3. That a new Chapter 13 of the Code of Ordinances of the City of Paris, Paris, <br />Texas, be, and the same is hereby, adopted so that such shall read as follows: <br /> <br />"FLOOD DAMAGE PREVENTION ORDINANCE <br /> <br />ARTICLE I. IN GENERAL <br /> <br />Sec. 13-1. Findings of Fact <br /> <br />(a) The flood hazard areas of Paris are subject to periodic inundation, which results <br />in loss of life and property, health and safety hazards, disruption of commerce and <br />governmental services, and extraordinary public expenditures for flood protection <br />and relief, all of which adversely affect the public health, safety, and general welfare. <br /> <br />(b) These flood losses are created by the cumulative effect of obstructions in <br />floodplains which cause an increase in flood heights and velocities, and by the <br />occupancy of flood hazard areas by uses vulnerable to floods and hazardous to other <br />lands because they are inadequately elevated, floodproofed, or otherwise protected <br />from flood damage. <br /> <br />Sec. 13-2.
