<br />General Provisions. <br /> <br />ARTICLE X <br /> <br />NOTICE REQUIREMENTS. <br /> <br />Section 10.01 Child Abuse Reporting Requirement. This section applies to <br />mental health and substance abuse contractors and contractors for the following <br />public health programs: HIV /STD; Family Planning (Titles V, X and XX); Primary <br />Health Care; Maternal and Child Health; and WIC Nutrition Services. Contractor <br />shall make a good faith effort to comply with child abuse reporting guidelines and <br />requirements in TEx. F AM. CODE ch. 261 relating to investigations of reports of <br />child abuse and neglect. Contractor shall develop, implement and enforce a written <br />policy that includes at a minimum the Department's Child Abuse Screening, <br />Documenting, and Reporting Policy for Contractors/Providers and train all staff on <br />reporting requirements. Contractor shall use the Checklist for Monitoring as. <br />required by the Department located at www.dshs.state.tx.uslchildabusereporting. <br />Contractor shall retain reporting documentation on site and make it available for <br />inspection by DSHS. <br /> <br />Section 10.02 Significant Incidents. In addition to notifying the appropriate <br />authorities, Contractor shall report to the Division Contract Management Unit <br />assigned to the Program Attachment ,significant incidents involving substantial <br />disruption of program operation or potentially affecting Department funded clients <br />or participants within seventy-two (72) hours of discovery. <br /> <br />Section 10.03 Litigation. Contractor shall notify the Division Contract <br />Management Unit assigned to the Program Attachment of litigation related to or <br />affecting this Contract and to which Contractor is a party within seven (7) calendar <br />days of becoming aware of such a proceeding. This includes, but is not limited to <br />an action, suit or proceeding before any court or governmental body, including <br />environmental and civil rights matters, professional liability, and employee <br />litigation. Notification shall include the names of the parties, nature of the litigation <br />and remedy sought, including amount of damages, if any. <br /> <br />Section 10.04 Action Against the Contractor. Contractor shall notify the <br />Division Contract Management Unit assigned to the Program Attachment if <br />Contractor has had a contract suspended or terminated for cause by any local, state <br />or federal department or agency or nonprofit entity. Such notification shall include <br />the reason for such action that includes the name and contact information of the <br />local, state or federal department or agency or entity, the date of the contract, and <br />the contract or case reference number. If the Contractor, as an organization, has <br />surrendered its license or has had its license suspended or revoked by any local, <br />state or federal department or agency or non-profit entity, it shall disclose this <br />information to the Department by submitting a one page description of the reason(s) <br />for such action that includes the name and contact information of the local, state or <br />federal department or agency, or entity, the date of the license action, and a license <br />or case reference number. <br /> <br />General Provisions (Core Subrecipient 2008) <br /> <br />6/1212007 <br /> <br />15 <br />
